As I mentioned to you on the phone last night, I call Mr. Odle yesterday evening (8:11 PM to be exact) to talk to him about his new complaint, when he answer the phone I told him who I was and what I was calling about, when I asked him he refused to tell me what exactly his complaint was, so I told him I had received an email in which he was complaining about a sinking trench. "His answer was I'm listening" At that time I told him that you and I had been to his property to check and take picture of the area where the cable was buried and that we did not find a sinking trench, in fact there was no trench at all, that what we found was a small depression (about a half inch deep and about two inches wide) in the ground along the buried cable line. I also told him that we would go to the store buy some top soil and be out there this morning to level off that depression on yard. When I had finished telling him that his answer was "I'm listening" I asked him what he meant and he said "what else are you going to do" I told him that according to the email he sent to the city of Coppell and what you and I had seen there was nothing else to be resolved. His answer was that I needed to compensate him, when I asked him what for? he said for the time he spent on his previous complaint about the (Robo- mower) wire. I told him I knew he had been paid in full for the damages and his time on that issue, according to him that did not matter because that payment was from the other contractor and that we still needed to pay him as well and that until we paid him for that damage he would stop his complaints. I made him aware of the fact that if he was trying to get a second payment for the damages for which he had already received full payment it amounted to fraud, when I told him that he said I had insulted him and hung up the phone. This morning at 11:30 1 arrived at his property to make sure my crew placed enough top soil on the buried cable route to level off hiss yard, the guys had already been there for about ten minutes, they told me that when they got there they found Mr. Odle pushing down on the ground with his feet along the buried line trying to make depression deeper and that Mr. Odle had told Keith Marvin - 119 Mesquitewood them that the soil would not be good enough and went inside. We put the soil on took some pictures and left. Please note that on picture one and nine, the dead grass there is not due to our work but the result of Verizon working there. Page 2 Santos
