Our infomlation shows that you are the owner of this tract of land on the north side of East Bethel Road, irrunediately west of the bridge. "I'he property in question is in an identified floodplain and floodway of Grapevine Creek as shown on Flood Insurance Rate 1V1ap #481 1 ~C O155J effective date of August 23, 2001. Placement of fill in a designated floodplain area or floodway is a violation of the City of Coppell's Floodplain Ordinance #2001-952. That ordinance specifical]y states that a Floodplain Development Permit is required for all new construction, development and encroachment within the floodplain management areas of the city. Fncroaclvnent is defined as "f~1y activity in a floodplain which could hinder the passage of water or otherwise flood flow/s; i.e., fill, building, fences and so on." Development is defined as "Any manmade change to improve the unimproved real estate including, but not limited to, buildings or other structures, mining, dredging, filling, grading, paving, excavation or drilling operations Located within the floodplain management areas of the city. A Floodplain Development Permit is required for all development within a floodplain." f~,looclplain management area is defined as "The combination of all floodplain and regulatory floodways within the jurisdiction of the City, including floodplain ]and. that is not ident,fi,°d ~~>> Flood Lazard Boundary IV1aps or Flood Insurance Rate ~1aps". However, the property in question is noted on our above referenced floodplain map as being within a floodplain and floodway of the City of Coppell The placement of fill dirt on this property is a violation of Floodplain Management Ordinance #2001-952. At this time, all activity on this site should immediately cease and desist and al] fill dirt should be removed from the site. "Any person who violates this ordinance or fails to comply with a~1}~ of its requirements shall upon conviction thereof be fined not more than five hundred dollars ($500.00) for each violation, be required to correct or remove the noncompliance, and each and every day such violation is continued shall constitute a ne~v and separate violation." ...
