Griffin, P.E., City Engineer ~-~ SUBJECT: Phone Conversation with Mr. David Bain 700 Block of East Bethel School DATE: July 23, 1992 Mr. Bain has written several letters to myself (copies attached) concerning drainage issues associated with this property. He and I have spoken several times in the past, and most recently, we spoke on July 23, 1992. Mr. Bain has a concern with trees that have fallen in the drainage easement and has a concern with whether or not the City is going to extend a drainage system. You may recall that I spoke with you concerning a supposedly commitment on the City's part to extend the system at some point in the future. Your recollection was that the City had not committed to enclose this system at any point in the future. Mr. Bain was not pleased that the City was not going to extend the system and that the City was taking no responsibility for maintenance of the drainage easement. I conveyed to Mr. Bain that this has been the City's policy on the maintenance and upkeep of drainage easements, i.e. no maintenance from the City's prospective. He stated that he will consult his attorney concerning the drainage easement. This memo is written to you as information in the event that you are contacted concerning this situation. Bethel School Rd. and .... Pelican experianced flooding due to insuffient street drainage· This has been _...._ . - . resolved with the installation of several new drain outlets which are working - well and obviously sincerely appreciated by the residents. At the time of this situation, we also advised of drainage ditch problems on the .:~ ~.. west side of Lot 6, 721 Bethel School Rd., which is an easment. Only a . _ -' ._ portion of the drainage easment is "encased" (approximately 120 ft.) and the ......... City informed that funds were not appropriated, at that time to fully enclose the drainage the extent of the property. Nothing has transpired since. · - - Recently, during an electrical/thunderstorm a tree (in the drainge easement) was uprooted (possibly caused by the flow of street water) and toppled into our fence causing damage. Upon inspection by the streets deparment, we were advised that they could not remove the fallen tree since it is on private property. Although on pdvate property, we solicit that if the easement grant is to continue, which appears necessary, then the City must take the · - _ responsibility to fully encase the open ditch and not leave exposed. The exposure of the open ditch presents safety concerns. In addition, the pooling of drain water from public streets in this area causes health concerns, as it is an _. ideal haven for mosquito and other insect breeding. The easement located - '" '~ ' ~ through private proerty is not intended nor entitled for this purpose.
