Presentation was given by Shohre Daneshmand regarding issues at
hand and that Kimley Horn was hired to resolve the problem.
Ron Morrison presented two reports:

1) Research the files in which Gilbert Welch provided a large
part of the information.
2) Determine condition of drainage (flat area). Also the
condition before construction of Shadow Ridge.
3) Department of Agriculture would deduct soil content in
relation to high water table. Determine if it was good area
to maintain standing water. The topographic map would be
one of the main considerations in determining condition of
soil.

5) At onset of construction of Shadow Ridge subdivision, there
was a normal drainage problem, as the area was flat. They
are aware of the interfacing of the subdivision and Kaye
Street, overlooking this would be an error on their part.

Solution (Alternatives)
1) Build grass line swell between Kaye Street and subdivision
along the fence line and drain water off (not a good option
because back yards would need to be dedicated for this).
Also, they are not sure about the way the water drains, as a
survey has not been done.
2) Concrete swell along the alley may be an alternative, but
this would be expensive. No survey info£mation at this
time.
3) Storm drain to catch standing water from area drains. This
drainage system would accommodate a 10 or 5 foot pipe. This
is the most plausible alternative and was recommended.

Not actually a report, but survey was to identify a sufficient
fall. This was looked into as a quick fix. An existing drainage
pipe along the back of Shadow Ridge homes could dump into Spanish
Moss Court. This would not be an ideal situation.
Information came through a comprehensive Sto£m Water Study
Report. Related problems that existed and were solved were
studied carefully and identified. The less scientific method to
dete£mine how to fix this problem was to send engineers to visit
with people and try to get a full picture of problem. Along with
this, and surveys, several alternatives were agreed upon.
StiQmaticall¥ or Systematically, it shows solution at back of
lots of North Kaye Street to be characterized by the following:
a) Area drains connecting to sto£m drains, conveying to
sto~., system in Spanish Moss Ct., according to Mr.
Spellman's field visit. Based on this assessment,
existing improvements (trees) could be avoided.
b) Would be easy to work with the PVC pipes, dodging
improvements as much as possible. Research would be
done to dete£mine if any long-teEm maintenance would be
required.
Shohre then announced that August 28th, the City Council
authorized recommended options to this drainage system option and
that Staff was to meet with neighbors and that City would require
100% participation to make this project work. City would need

room to construct this system at an estimated cost of $102,000.
After meeting with Centex/Fox & Jacobs, Fox & Jacobs agreed to
provide $30,000 + $10,000 for complete construction engineering
plans. City Council decided to take care of rest of this.
Some items during construction of this project, that would
require your cooperation, are resodding, removing of trees,
sheds, grading. Customized systems on an easement would
definitely be carefully done and surveyed to save these items
previously mentioned. Your help is needed to be cost effective.
The utility easement on Spanish Moss is considered in this
solution.
Weather pe£mitting, along with 100% cooperation from home owners,
would be essential to complete this project in 3 to 4 months with
no problems.
QUESTIONS AND ANSWERS
Jim Speier of 335 Spanish Moss Court started with the first
question. If you have two lots of equal value, would granting of
draining easement devalue his property in any way? Shohre said
that it shouldn't, but that she would look into finding his
answer. Walter said that only the outfall would work to stream
water further to the east of the properties into a tributary.
Also, the inlet of 4 feet would be no problem, as it is still
part of the plat. To fix the pipe for drainage easement would be
no different from utility easement maintenance.
Blake Svejkovsky of 331 Spanish Moss stated that further east
there was an empty field, in which there is another drainage
problem. This issue was requested and needs to be addressed and
taken care of.
Shohre said that construction of a storm drainage would not solve
all near-by drainage areas, but they would need these drainage
problems addressed and considered in constructing the project.
In construction of Spanish Moss, part of the utility easement may
be needed and this would require cooperation from the residents.
Shohre added that it would be more difficult in the actual
construction work on Kaye Street, but that they would work with
residents regarding trees and take care in avoiding removal of
trees, fences, etc.
Gilbert Welch, representing his mother, Mrs. Welch, of 403 Kaye
Street and 412 Kaye Street, stated that Mr. Morrison was

incorrect in that the Spanish Moss did drain. In response to
Jim's question about devaluation, storage buildings, swimming
pools, etc. built on or close to easements should have met the
City's restriction codes.
Mr. Welch commented that if someone wants something done, it is
the City's responsibility and that he appreciates the City's
actively solving the problems. He doesn't have a problem
replacing trees, resodding, etc. but the regrading should not be
the responsibility of the home owner. His mother spent $700.00
on regrading because the City said that it was her
responsibility. Of course, Fox & Jacobs refused to take the
responsibility. With proper grading and design, the lots should
drain. As part of the cost of putting in pipes, relocating
buildings should be included in the price. He thought that it
wasn't wise to not include grading in price, as the whole back
yard has low spots in this route and at the price of $102,000,
grading should be included.
Shohre assured him that his comments would be answered and she
would get back with him, and he had made an excellent point. In
the City's walk through the back yards and talking with the
people involved, she appreciated their time and effort. Her
main concern for this easement was getting the lowest price, but
getting high quality work. Whenever the survey has been done,
she will take a quick look at what is actually being done and
discuss it with each individual resident.
About a year ago, Mr. Welch said that the City Manager started to
work on this problem, but nothing had been done. He appreciated
the fact that finally something is being done.
Shohre added that they will try to miss the trees, but staying in
a straight line as much as possible. No alleys or other utility
work will be put in. With this commitment, 3-4 months should be
sufficient time to complete this drainage project.
Dean Hensen of 320 Kaye Street stated that he didn't agree with
Ron that the water didn't drain on Kaye Street. He had lived on
Kaye Street for twenty years and the water had always drained.
He is aware that there is a problem now and in order to minimize
flooding, the sto£m drainage system would definitely help. There
are area drains (outlet bumpers) with TVP pipes as it is now.
The new drains will be 12" X 12" inlets, flush with the ground,
landscaped accordingly. Dean inquired about whether future
maintenance would be ideal or not and if the resident had the
legal right to refuse the City to come in and fix the problem.
Most driveways are to the fence lines, and that this would be a

long-term process. Shohre agreed to look at this.
Being a Kaye Street owner over many years, there is no standing
water and he didn't agree with the current recommended project
option and that there should be another solution. That being,
tell Fox & Jacobs -- you created it, you fix it!
Terry Lewis of 416 Kaye Street said that there is good drainage
and he agreed with Mr. Welch that homes built 4 feet higher by
Fox & Jacobs didn't help the situation. On easement itself, the
inlet swell pulls water to necessary designations, creating a
surface overflow. Mr. Lewis asked how many inlets are being
placed. Walter said, "Located at one per yard, where survey
indicates water collects." There is a concern as to how the
water was to drain. There was no surface drainage.
Shohre mentioned that easements of 10 feet would be necessary or
desirable. But Steve Goram commented that it would probably be
more appropriate to go with four feet drainage easement, as
inclined by the survey.
Mr. Lewis said that his mother thought she had lost property,
because her fence was put back about 10 feet.
Shohre said that in the completed construction design, there
would be better maintenance. Fox example, if there are two
fences and there is trapped grass in between these fences, they
would just put one fence back to eliminate this problem.
Mr. Welch questioned Shohre about the 100% participation that was
needed to complete project. The City was committed to solving
problems and didn't have any other options. Money was there and
the best alternatives were available. He realized that City
wanted the best solution and that timing factors were essential.
He was in favor of issues and that we should take next step to
carrying out the project. Shohre told him that her next step was
to send letters out to the Kaye Street and Spanish Moss Court
residents, verbalizing this project and stating that they are
going to begin work. Documentation of existing structures and an
overview of what would be taking place in the next few months,
should be distributed. She would then ask for any responses or
comments. Shohre would meet with Dean and solve his problems.
She also agreed that she is willing to address and help solve any
existing problems associated with Kaye Street and Spanish Moss
Court. All comments would go the City Council meeting on current
drainage option. This drainage option is more expensive, but has
the overall solution, even though it will not solve everyone's
individual problem.

Mr. Ken Mills of 431 Spanish Moss agreed with Gilbert Welch. He
added that he did not receive any letters from the City regarding
the drainage problem. Shohre said she would check on this.
Shohre agreed to meet with and discuss with Kaye Street and
Spanish Moss Court residents their individual drainage problems
one on one.
Dean Henson said that on Spanish Moss Court there was water
underneath the fence and behind his home. His neighbor, also,
had water problems, although he would not address his issues.
Shohre said that all residents of Kaye Street and Spanish Moss
Court would be totally informed before we start the project, and
they would provide enough details on how a 15" pipe will carry
water efficiently.
Ron Morrison said that with a sufficient survey, drainage could
be determined. They would take a thorough look at Spanish Moss,
Kaye Street, and Shadow Ridge before designs are made for the
drainage system.
Other areas needed to be looked at, but were not large enough
items at this time.
