RE: Consideration and approval of a resolution calling for a Public Hearing on
January 10, 1995 to consider Land Use Assumption, a Capital Improvements Plan
and the imposition of Impact Fees for Water and Wastewater in accordance with
Chapter 395 of the Local Government Code.

In May 1994, the City of Coppell entered into a contract with Rady and Associates to revise our
Capital Improvements Plan and to make recommendations on the Impact Fees needed to
implement the Capital Improvement Plan. This item has been taken to the Planning and Zoning
Commission for a recommendation to the City Council. Previously, Council has approved Land
Use Assumptions to be utilized in the implementation of a Roadway Impact Fee. However, the
City also needs to adopt Land Use Assumptions to be utilized in the Water and Wastewater
Impact Fees. The only difference between these Land Use Assumptions and the Roadway
Impact Fee Assumptions is that for Water and Wastewater purposes the City of Coppell is
viewed as one zone, not ten zones. When you do a consolidation of Land Use Assumptions with
the Capital Improvement Plan, Chapter 395 of the Local Government Code requires a minimum
of 60 days after publication of the first notice in the paper before you can hold the public
hearing. Therefore, the public hearing will not be held until January 10, 1995.
All documentation concerning this item will be processed with the Council packet for the
January 10th, 1995 City Council meeting.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COPPELL, TEXAS,
ESTABLISHING A PUBLIC HEARING DATE TO CONSIDER AMENDMENTS TO THE
LAND USE ASSUMPTIONS, CAPITAL IMPROVEMENTS PLAN AND IMPACT FEES
FOR WATER AND WASTEWATER FACILITIES; PROVIDING FOR THE GMNG OF
NOTICE OF THE PUBLIC HEARING; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City Council of the City of Coppell, Texas previously adopted land
use assumptions, a capital improvements plan, and impact fees for water and wastewater
facilities, as required by Chapter 395 of the Texas Local Government Code; and
WHEREAS, Chapter 395 of the Texas Local Government Code requires the
governing body of the City of Coppell conduct a public hearing to discuss the amendments
to the land use assumptions, the capital improvements plan, and impact fees for water and
wastewater facilities;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF COPPELL, TEXAS:
SECTION 1. That the City Council of the City of Coppell, Texas, shall conduct a
public hearing on January 10, 1995 at 7:30 p.m. to consider the adoption of amendments to
the land use assumptions, the capital improvements plan and impact fees for water and
wastewater facilities.
SECTION 2. That on or before the date of the first publication of the notice of the
hearing on the amendments, the land use assumptions, and the capital improvements plan
for water and wastewater facilities, including the amount of any proposed amended impact
fee per service unit, shall be made available to the public.

SECTION 3. That pursuant to Section 395.055 of the Texas Local Government Code,
the Assistant City Manager is directed to cause a Notice of Public Hearing on Amendment
of Impact Fees to be published once a week for three consecutive weeks in the City's official
newspaper in a size not smaller than one-quarter page of standard size or tabloid size
newspaper, with the headline of the notice to be in eighteen point or larger type. The first
notice shall appear on or after the 60th day before the date set for the hearing but before
the 30th day before the date set for the hearing.
SECTION 4. This resolution shall become effective immediately from and after its
passage, as the law and charter in such cases provide.
