On Wednesday, you and I discussed the Engineering Report dated September 1, 1988, by Ginn, Inc. Consulting Engineers. We discussed the useful need for close coordination between the City's contractor and your contractor, so that one operation won't adversely impact the other, or at least keep it to a minimum. After deliberating about that, you directed me to have the City pursue it's work irrespective of any impact on your property. We will pursue cleaning out the culvert and downstream drainage channel. Our contractor will work solely on public right-of-ways and/or City owned property. We cannot and will not be responsible, nor liable, for any of your land, property or landscaping, due to our operations. As you directed, ycu will be responsible for grading, blending or any coordination necessary, while the City contractor restores the culvert and downstream drainway conditions within the public right-of-ways and land. If you have any questions, please do not hemitate to call. Stncerely,~ xc: Alan Ratliff, City Manager Steve Goram, Director of Public Works Shohre Daneshmand, Civil Engineer Kevin Peiffer, for Wayne Ginn, Inc.
