It's ok to place a "Public" Utility in a combined Fire Lane /Utility Easement. However, it sounds like
the gas line is a "Private" Utility so it cannot go in a "Public" Utility Easement. You need to find a
different route for the "Private" gas line.

Would it be acceptable to you to combine a public utility easement for franchise utilities with the fire lane
easement on the plat? ATMOS Energy said they could run their gas lines to the building in the fire lane if we
dedicated it for their use also.
