Bethel I will not require a permit. We will revise the original permit
to exclude the portion of G-1, from Freeport to north of Bethel Road.
The culvert crossing is not included in the jurisdictional waters
either. I think that she is going to take into account what we do
upstream of the jurisdictional portion. The good thing is that we will
not have to pay mitigation points for this section either.

Since we will be over 500 linear feet, it is at the USACE's discretion
whether or not to authorize under the nationwide permit so it is very
possible that Jessica will require the individual permit. However, the
reduction in linear feet will still allow the Tier I questionnaire for
the TCEQ 401 water quality certification and that is an important
reduction in review. TCEQ can be very difficult sometimes.
Did Jessica still want to permit the impacts from the two projects
(Bethel I and Bethel II) together? That's the way we had submitted it
since the timeline for the two projects was so close and to avoid having
to go through the permitting process twice.

Bethel II is scheduled to advertise in the 3rd quarter of 2005. We
have
not started the right-of-way acquisition and there are traffic control
issues that need to be resolved. I think that the 3rd quarter is
optimistic.
I believe that Jessica said that this project would still require an
individual permit. I did not understand what all she was saying. If
I
understood correctly, what we do with this section of stream in Bethel
I
will still have an impact on the portion in Bethel II. She still
wants
us to consider a tree buffer and forcing the pilot channel through one
culvert.

I just found out that Ken is out all of this week. I will work on
getting a meeting set up when he gets back.
Will the Coppell Rd. improvements be advertised for bid the same time
as the Bethel Rd. project? I think the original channel grade between
Bethel Rd. and Coppell Rd. was graded to drain with the transition
downstream of Coppell Rd. We should just have to modify the submittal
to the USACE to reflect the revised jurisdictional determination and
therefore, quantification of impacts. The project should not require
a
Tier II review for the 401 water quality certification (from TCEQ) now
which means TCEQ will not provide any review. We will just need to
fill
out the Tier I questionnaire which is just a checklist of which BMPs
will be employed during construction. After looking at the drawings
again, I think the total project is just over 500 linear feet, but the
USACE may still approve the project under nationwide permit 13 for
Bank
Stabilization. Will still need to do the notification since over 500
linear feet, but that would decrease the review time overall since the
coordinating agencies would not be involved. This is a possibility we
should discuss with Jessica after our meeting and when we have a good
handle on what the revised impacts will be.

TranSystems was supposed to have the plans completed back in August -
they are not complete yet. Three of the four boxes will be
temporarily
blocked until the new channel is complete. The existing channel will
have to be graded for positive drainage, from the end of the proposed
improvements to the existing box at Bethel Road. I am not sure how the
construction of the channel and the culvert under Bethel is supposed
to
be sequenced. That is an issue that Ken will have to decide.
There is only one right-of-way parcel that has not been acquired and

once it is acquired we will initiate utility relocations. This
project
is supposed to advertise in the 1 st quarter on 2005. I think that we
can revise the permit and stay on schedule with this project.
