We live in a new Coppell subdivision and have a storm sewer installed that runs along the fence in the back yard
in an easement. This is a mosquito breeding hazard as the storm sewer never drains completely, was obviously
installed poorly, and now still has several inches of water in it. It is very, very likely to breed mosquitos this
year. (Last year the minimal rain kept the problem down, but it was never dry even last year, always had an
inch or two of water.) The developer knows of the problem, tried once to fix it last year to no avail, and now I
don't know if the developer will fix it or not, but I assume he will try again. He is a reputable builder developer.
I think the storm sewer needs to be re-done as the past "fix" did little good. (I am fairly familiar with
subdivisions as I finance them - this could be a fairly expensive fix, though no road would be involved, just
movement of the line.)
My question to the City of Coppell is if the developer will not fix this correctly, can I force the issue with the
City? In other words, although the City has approved and accepted the subdivision, since this was obviously
done incorrectly, can the City force him to fix it because it's a health hazard?
I am not ready to turn the developer in as he deserves a chance to do the right thing but short of contacting my
attorney, your answer can provide some guidance. You may want to forward this to the city engineer and/or city
attorney.
