Dear Mr. and Mrs. Andolia:
It has recently come to the attention of the City of Coppell that debris in the form of wood products has been
deposited within a floodplain of Grapevine Creek. It appears that the material could have been washed from
the back of the site at 794 South Denton Tap Road at some time during one of the prior rain events. The
debris does have a potential to continue to travel downstream and eventually block a culvert, which could
cause flooding in this general area.
The encroachment of debris within a designated floodplain is a violation of the city's Floodplain
Management Ordinance # 2001-952. As defined in the Floodplain Management Ordinance, encroachment
covers things such as fill, buildings, fences, and other types of material, which could affect water flow.
Prior to any encroachment taking place within a floodplain of the City of Coppell, a Floodplain
Development Permit is required. Obviously, the City of Coppell would not issue a Floodplain Development
Permit for depositing of debris within a city creek. By virtue of this letter, I am requesting that the
debris that has been washed from your site into the floodplain of Grapevine Creek be removed within
fifteen (IS) days of the receipt of this letter. The debris can generally be found in the creek from the back
of your property northward toward Bethel Road.
According to the city's Floodplain Management Ordinance #2001-952, failure to comply with this request
"shall upon conviction thereof be fined not more than five hundred dollars ($500) for each violation, be
required to correct or remove the noncompliance, and in each and every day such violation is continued
shall constitute a new and separate violation."
I am aware that the property is currently vacant at 794 South Denton Tap Road and that the washing of the
debris to the floodplain of Grapevine Creek was not intentional. I do want to work with you to bring about a
successful resolution to the removal of the debris from the floodplain of Grapevine Creek. If there is some
overriding circumstance that would prevent you from having the debris removed within fifteen (15) days
please call my office to arrange a suitable timeframe for removable of the debris. However, because of the
potential to create flooding, the timeframe for the removal of the debris will still be a very short time frame.
