Dear Mr. Salazar:
Please be advised that we are in receipt of your letter dated April 2S, 2007 concerning the
informal review by the City of Coppell relating to an application for Amegy Bank development
plans on the corner of Hackbetxy and Beltline Road located in the City pf Irving, Texas. Initially
the City was given a set of development plans in late December of 2006 concerning the above
referenced application filed in the City of Irving. The representations provided in your letter that
the City is somehow required to process such commercial plan review, checklist and
development pernnit applications is not entirely aceura#e. However, the City did review the same
to determine whether or not access onto the street located in the City of Coppell was appropriate
and met the needs of the City of Coppell concerning traffic related issues. The City Engineer,
whose department oversees the public right-of--way and plan. review for such documentation, has
conducted a limited review for the purposes of determirzzng access onto Hackberry Road located
in the City of Coppell. The Engineering Department did conduct a timely review and provided
his comments which were referred to special counsel. Through inadvertence by special counsel,
such comments were not foz~+~arded to the City of In~ing for inclusion to the $illingsley
application submitted to the City of In~ing.
It is our position that there is nat a formal application filed with the City of Coppell.
Since access on a public street located in Coppell for a development in a contiguous City, we
have forv,~arded our comments to the City of Irving. The City of Coppell's comments havE now
been forwarded to the City of Truing for inclusion into its processing of the application pending
at the City of Irving. It is the position of the City of Coppell that this matter is outside of any
pending litigation concerning our respective clients. However, the same was being reviewed by
special counsel for the proposes of eliciting their expertise regarding traffic flow on Hackberry
Road in Coppell, its impact on subsequent development across Beltline Road within the City of
Coppell and the regional traffic I~aw at this critical intersection.
