Pursuant to the above referenced request, please be informated that the
City of Coppell does not have any regulations governing the formation of
these type of Associations. In researching your request, I have been
advised by our City Attorney that it would be necessary for you or your
group to consult with a private attorney to form an Association as a
non - profit corporation in accordance with the laws of the State of
Texas.
The City's current Subdivision Ordinance and Streetscape Plan addresses
submission of a Homeowner's Agreement upon request for approval of the
City Council for a final plat on new developments. These requlations
were adopted in 1984 and 1985; however, the platting process for
Shadowridge Estates and Whispering Hills was approved by the City
Council prior to the adoption of these regulations and the developer,
therefore, was not required to submit this Agreement.
On behalf of the City, I welcome your interest in forming such an
Association to represent the property owners of your sub - division, and
would request a list of officers of the Association, when established,
for our files and reference.
