Dear Mr. Griffin:
Please accept this letter as our second request for an
extension of time on the above referenced project in
response to our phone conversation of March 20, 1992.
The following information is per your request to receive
additional information concerning our first request of
a time extension dated March 11, 1992.
Our request for an extension of time is based on the
contract between Rhode Construction Co. and the City of
Coppell, specifically Page 6.9, Paragraph 4.02 of the
General Conditions. This paragraph states in fact that
the Contractor will be entitled to an extension of time
due to unavoidable causes or casuses beyond the Contractor's
control, certainly weather is beyond the Contractor's
control.
Further, there is no statement in the Contract that excludes
weather as a cause. Therefore, we believe that the abnormal
amount of rainfall is grounds for the extension of time as
requested.
Also, as you are aware, the Kaye Street Drainage Project has
been constructed under extreme adverse conditions as relating
%o property owners and right-of-ways. These conditions were
not created by Rhode Construction Co., we as the Contractor
inherited these problems which we have handled in a sedulous
and professional manner, which can be witnessed by the Land
Owner's and also, by Mr. Larry Davis, Inspector for the City
of Coppell.
The time allotted for the above referenced project was 60
calendar days. During these 60 calendar days, there were
possibly 43 working days total. We have worked 36 full days
and 2 half days. In this same period of time, it has rained
21 days out of the 60 days and as you know, after a rain it
will take one or two days afterward for the ground to dry
enough for work to resume to normal production. On this
project, we worked in the rain in order to try to complete
the project within the alotted time frame.
In order to do the job, 10 days were used excavating the
entire right-of-way down 1½" to 2" deep in order to find
ground that was hard enough to operate the equipment on.
All this mud had to be hauled out and stockpiled and will
be hauled back in to fill %he right-of-way which takes
additional time. Our production was slowed to 20% to 25%
of normal production for many of the 60 days alotted due
to the above.
Again we would ask you to consider extending our completion
date to April 7, 1992.
