Re: Kaye Street Drainage Project
Dear Mr. Huddleston:
This letter will serve as your official notice to begin work on the
referenced project. Based on the date of this letter, your calendar days
will begin no later than January 20, 1992. If you begin work prior to
January 20, 1992, then your calendar days will begin when you actually
start work.
I have reviewed the revised Change Order No. 1 from Carter & Burgess and
it appears to be in conformance with what we discussed. You have also
requested that you be compensated for the portion of your project
incidental cost that was included in the ninety-one (91) feet of pipe
deleted from the project. Based on Section 2.15 of the General Conditions
of the contract, that request is being denied. Section 2.15 entitled
"Changes and Alterations" gives the Owner (City) the right to make changes
in the line, grade, form, dimensions, plans or materials either before
or after the beginning of construction without affecting the validity of
the contract. The same section goes on to state that if the chan~e
diminishes the quantity of the work to be done, that that shall not
constitute the basis for a claim for damages in the work that was
dispensed. Also, Section 6.01 entitled "Change Orders" allows the Owner
(City) the right to order deletions or revisions to the work. If you
disagree with this decision, you should read Section 5, entitled
"Measurement and Payment" and Section 6 entitled 'Extra Work and Claims"
and follow the steps laid out in those sections and the rest of the
contract.
