We are hoping that the DFW Airport issue does not become a major issue. We received our License Agreement from DFW Airport
in 2004 to "construct and maintain a road on DFW Airport property". We foolishly assumed that a License Agreement granted by
DFW Airport was all we needed to build the road. However, Curtis Inglis, DFW Airport Building Official, stated that we also needed
a permit from him. This was the first time that information had been conveyed to the City. The meeting centered around the
permit and rather or not Bethel Road was on DFW Airport property. The meeting ended with Mr. Inglis stating that he would let us
know if a permit would be required and if it was, the extent of the permit. Apparently the permit can be very simple and routine or
complicated and drawn out.
One thing that did cause me some concern was that after the meeting, Mr. Inglis came to my office to bring up the DFW Airport
web site to show me that permits were required. As he was leaving, he stopped and turned around and asked me if I was aware of
the fact that there is a revenue sharing agreement that DFW Airport would like the City to sign. I assured him I was aware of it
because every time I meet with DFW Airport about this project that issue comes up. I'm not sure if it was an innocent mention or a
veiled threat concerning the future permit for Bethel Road.
Grapevine may have bigger issues because there was a lot of discussion about the bridge in Grapevine and the creek that crosses
Bethel Road. Apparently, Grapevine does not have any permits for that work. You may recall that it took us a mere two years to
obtain our permit for the Loch Lane creek. I spoke with Grapevine's Public Works Director, Matt Singleton, Monday and he stated
that Grapevine has recent history with DFW Airport where DFW Airport revoked a License Agreement during construction by issuing
a cease and desist order.
My recommendation is to wait and let Mr. Inglis get back with us on the permit. Once we have that information we will know how
to proceed. If he is reasonable, then we can obtain a permit and move forward. It the permit is not granted or the requirements
are unreasonable, then we will need to discuss our next steps. We are on a schedule to bid the project in July 2006/ assuming
DFW Airport doesn't stop us.

I know you have a lot going on right now. I have been reading about
your land dispute lawsuit with Dallas... .sounds like another of our
friends (DFW) are wanting to play hardball on the ownership of Bass Pro
Drive/Bethel Road. It might be a good idea for us to talk about
this....1 have some background I want to share with you when you have
some time in the next few days. Just let me know...a phone call would
work or I am happy to come over and visit with you.
