RE: Kaye Street Drainage
Dear Gary:
Per your request, following is a summary of our understanding of the situation concerning
the drainage easement on the west side of Mr. Blake Swekovsky's property and the current status
of the Kaye Street Drainage project:
1) Centex has made arrangement with Mr. Swekovsky to obtain the easement on the west side
of his property in exchange for monetary consideration and some plant materials to be
provided to him tbr his own use. It is anticipated that the easement should be ready on
Thursday or Friday dependent on final arrangements with Mr. Swekovsky.
2) My understanding is that the City has committed to replace Mr. Swekovsky's fence with an
8' fence as part of the construction contract. In. addition, disturbed landscape will be
replaced as necessary during construction.
3) Centex will continue to provide engineering support services to the City through Ca~ter and
Burgess in terms of miscellaneous inspections, payment request review and survey staking
through the conclusion of the project.
4) We also understand that Centex (with exception of the items discussed above) is under no
further finandal obligation to the City tbr the construction of the project as the City Council
has agreed to fired the construction. Note that a substantial sum has already been expended
by Centex for the desi~ phase and ibr the easement acquisition on Mr. Swekovsky's
property.
If any of the above information is contrary to your understanding of the project
arrangements, please call me hnmedlate!y. It is excitin~ to see that this problem that has plagued
everybody involved is so dose to resolution. If I may be of fiirther assistance, please call.
Sincerely,
