alleging were not caused by any wrongful act, omission or negligence on the part of the City of
Coppell or any of its employees. For this reason, we must respectfully deny this claim in its
entirety.

I wanted to bring the enclosed claim to your attention, since the claimant is essentially accusing the
City of poor design on a subdivision that is approximately 25 years old. This particular subdivision
is one in which former Mayor Morton lives, and as a matter of fact this particular claimant lives just
up the street. Please note she has already secured two engineers who are talking about the poor
drainage situation and poor design.
I am sure our insurance carrier will turn this down, but that is probably not going to be the end of it,
so I just wanted to bring this to your attention.

adjuster in finalizing his report to TML.
1. Who actually built the storm drain in question and when was it built?
2. Who and when was the retaining wall that is suffering erosion damge built? It is
constructed of railroad ties. Provide copy of permit information if one was required
for the wall installation of the retaining wall.
3. Copy of work orders related to the city placing rocks in the creek?
4. Detail what work the city has done in response to this complaint?

The street paving, storm sewers. water mains and sanitary sewer mains on the above
referenced project have been constructed to the elevations-and grades as indicated
on the plans. To the best of my knowledge, all construcition has been performed in
accordance with the specifications of the City of Coppell.
The paving contractor still has some clean up work. This will be done at the
earliest opportunity.

complaining that her deck is leaning, and he verified that it is severely leaning and doesn't have enough

that a hold harmless agreement should have been signed by the homeowner when a was permuted. Avery
says that if he needs to access certain pipes on that property ,the deck will need to be dismantled.
T checked the file for 4l5 Dillard end no permit exists for a deck. Avery vaguely remembers when that
deck was installed, because he was out at that property for another reason. He recalls that it was probably 3
or 4 years ago.
The current homeowner claims that the City inspected a k, but she didn't own the home at that time,

I wanted to bring the enclosed claim to your attention, since the claimant is esserlcially accusing the
City of poor design on a subdivision that is approximately 25 years old. This particular subdivision
is one in which fortncr Mayor Morton lives, and as a matter of fact this particular claimazit lives just
up the street. Please note she has already securod two engincc~ who are talking about the poor
drainage situation and poor design.
1 am sure our insurance carrier will rum. thus down, but that is probably not going to be the end of it,
so I just wanted to bring this to your attention.
