Re: Silt and Erosion Problems in Magnolia Pazk Canal
Dear Mr. Thompson:
The city of Coppell has notified Rick Welton of TXI, Inc., Gary Bailey of TxDOT and James Cummings
regarding outstanding erosion control measures that need to be completed that have contributed to the build
up of silt at Magnolia Park. They have each agreed to provide a solution to erosion problems on their
respective property in a timely manner, and will notify us when the work is completed. TXI, Inc., has
recently installed erosion control measures that aze acceptable to the City. The Coppell Greens HOA has
also been notified to install remedial erosion control measures on their common area on the west side of the
subdivision.
TXI, Inc., appeared to be the major contributor in the preliminary investigation. However, after further
investigation, there was no single place found to pinpoint where most of the silt is originating. The measures
taken by each of the parties mentioned above should reduce the amount of silt entering Magnolia Park's
canal.
The City will continue to monitor the situation to ensure that these measures are maintained in the future.
When any further development occurs along this corridor, the City will review all erosion control plans in an
effort to prevent any problems from occurring in the future. If necessary, we will facilitate a meeting
between the various parties in an attempt to bring resolution to this matter. However, it is important to note
that the City has no liability or interest in formally entering a civil dispute between others that could
potentially arise from this situation.

We would like to make you aware of the adopted ordinances related to all properties (lands)
within the City of Coppell:
1. Erosion and Sedimentation Control Code -Ordinance No. 91514 was designed to
minimize erosion and sedimentation from private property onto public rights-of-way,
making it unlawful to permit a public erosion nuisance and providing for a penalty of fine
not to exceed the sum of $500 per day during which a violation occurs.
We respectfully request that you immediately resolve this public nuisance by re-establishing
vegetation and installing silt fence along this area to prevent further erosion.

I thought the company was TXI. TxDOT has previously paid the HOA some money. Regardless of the
company, Jim asked me to tell you to pass on that we will have our City attorney investigate what
involvement, if any, the City should have in this issue.

Ken,
Brian Thompson is calling the CM's office concerning the drainage problem over at Magnolia Park. It has
something to do with TXDOT wanting a release from any further silting problems that are occurring there
before they will help pay for the cleanup. Apparently Brian thinks that they need to provide more silt
fencing even though the project is complete.
When you get a chance, could you give me a call and update me on where this situation stands? I know
Mike has been dealing with him also but he is not here today either and I am not sure what the City's
position is on this situation. Chad seems to think that if we do not respond to him today that he will be
calling the CM's office again on Monday.
