SUBJECT: EXISTING 10' UTILITY EASEMENT

Per your request, attached please find a draft copy of a proposal I have
prepared addressed to Mr. Kent Darwin, residing at 327 Spanish Moss Court,
as a result of our meeting with him on Tuesday, October 15, 1991.
We recommend that a similar proposal be offered to Mr. Blake Svejkovsky,
residing at 331 Spanish Mos8 Court, who is also affected by this project.
A copy of the proposal is being forwarded to Larry Jackson for review and
comment.
I would also like to provide a brief Snmmnry on this proposed drainage
improvement regarding how the final construction route was determined.
- Since early fall, 1990, staff ha8 been negotiating with affected
residents to obtain drainage easements for construction of a storm
sewer system, as shown on the attached map.
- The final construction plans and contract documents were being
prepared by Carter and Burgess, Inc. (C & B, Inc.) on behalf of, and
as part of Fox & Jacobs active participation in this project. To our
knowledge, there has been no cash contribution made by Fox and Jacobs
other than receiving assistance in engineering plans preparation.
- While final plans were being prepared, Carter and Burgess explored
two (2) alternatives for coenectin~ the proposed system to the
existing storm sewer system under Spanish Moss Court in the vicinity
of.327 and 331SpanishMoss Court.
The first alternative solution would have required dedication of
drainage easements by two residents, residing at 331 and 335 Spanish
Moss Court, respectively Mr. Svejkovsky and Mr. Spair. Securing
easements along these lots became impossible due to unreasonable
demands for compensation suggested by those property owners. This
impasse led staff to look into a second alternative, being the use of
an existinq 10' utility easement along Lots 5 and 6 (331 and 327
Spanish Moss Court). Our legal counsel has advised us that we have
the right to use this easement for drainage purposes.
- By early September, 1991, all necessary drainage easements along Kaye
Street (from 5' to 10') were secured.
- We are proceeding wit~.-u~lizing the existing 10 foot wide easement
for tieing into the storm drain in Spanish Moss Drive.
- The implementation process for this drainage improvement is on
schedule. It is staff's intent to make a recommendation on the low
bidder to the City Council by November 12, 1991, with anticipated
construction completion by February, 1992.

RE: PROPOSED N. KATE STREET DRAINAGE IMPROVEMENT
Dear Mr. Darwin:
This letter serves as a proposal to address your concerns related to the
above referenced drainage improvement, proposed to be partially
constructed within the existing utility easement along your eastern
property line, (see Attachment "A').
The following conditions are proposed in an attempt to minimize the
inconveniency to you resulting from the construction phase of this
project.
1. A temporary solid screening fence will be erected along the
existing utility easement, during construction and one foot
outside of the existing easement.
2. All fences removed will be replaced to original location and
quality.
3. Damages to the existing landscape will be repaired to original
condition as nearly as practical.
4. After construction of the underground storm sewer system has
been completed or after any entry repairs or maintenance, the
City shall return the surface including any fence, to its
original condition as nearly as practical.
5. Trees will be replaced to an equivalent caliper and type tree,
not necessarily on a tree for tree basis, but on an inch per
inch basis.
6. If construction is not completed within thirty-five (35) working
days, weather allowing, and not including landscaping, the owner
will receive payment in the amount of $25.00 for each and every
day until the construction is substentially completed.
