City ~lnem£ SUBJECT: No. Ka~e Street Drainage Project DATE: J~e 25, 1991 As you know, the majority of homeowners have indicated that they are in favor of this project, and have verbally been supportive of granting the easement. However, we have been working with eight (8} residents, since January 1991, who had not been in favor of granting drainage easements and they are as follows: Mr. Curtis Jones 328 Kaye Street Mrs. Fay P. Gregg (deceased) C/O Mrs. Billie Sisk 340 Kaye Street Mr. Gerald Howard 404 Kaye Street Mrs. Sharon Brabham 400 Kaye Street Mr. and Mrs. Kent Darwin 327 Spanish Moss Court Mr. Blake Svejkovsky 331 Spanish Moss Court Mr. and Mrs. James Speir 335 Spanish Moss Court Attached, please find a copy of the Status Report (Attachment'A'), as a result of our meetings and comments with said residents. Please note that until recently, route #1 was the recommended route, along 335 and 331 Spanish Moss Ct. Due to lack of support from the two affected residents, we are currently analyzing the second route, between 331 and 327 Spanish Moss Ct., where there exists a 10' utility easement. (See attached location map) The difference in the estimated probable cost for the use of 2nd route is an increase of $10,000.00. The Engineering firm of Carter & Burgess (C & B) has completed the field survey collecting various information related to the construction of this project. At this time, the easement documents have been prepared, which are in the process of being executed with all residents. At the present time, C & B staff is drawing up the final construction plans and profiles, as well as, the construction documents. Shohre Daneshmand, Acting City Engineer Re: Kaye Street Drainage It is my intention to allow you to construct the necessary drainage improvements to alleviate drainage problems at the rear of my lot. I will grant a ten foot wide drainage easement and a temporary construction easement in conjunction with the construction of this project which allows the City to construct and maintain this facility as required. My granting this easement is based on the following conditions: 1. Any fences temporarily removed during construction be replaced to equal or better condition existing currently; 2. Any and all damages to the terrain or landscape of my property sustained during this construction be repaired or replaced to equal or better conditions; 3. Any necessary repairs to my fence or my property be taken care of within a reasonable amount of time; not to exceed 15 days from completion of construction of the portion of drainage system adjacent to my property. I understand the temporary construction easement will be abolished upon construction of the work. EASEHT Discriptton: This document describes the conditions for granting a five foot wide easement with one drain opening on the west side of 331 Spanish Moss Coppell, Texas. This ease- ment is granted for drainage only. Conditions of Easement 1) Total Job duration shall take no more than three weeks within the boundaries defined by 331 Spanish Moss, start to finish. The start of the Job shall be defined as the first day ground is broken or the first day fences are moved. The completion of the project shall be defined as the day that both the property owner and city representitive walk through the effected property and both agree that all conditions of this agreement have been met. 2) A fee of $100.00 per day shall be paid to Blake SveJkovsky for animal boarding, safety hazards and lnconvienience during the three week work period. Ail charges shall be based on whole day time periods, including weekends. 3) A penalty of $200.00 per day will be assessed and paid to Blake SveJkovsky for each day over the three week time limit. 4) Access to the described property that requires entrance to the back yard(fenced in portion) before the start day, shall require a $50.00 per day charge paid in advance to Blake SveJkovsky and fourty eight hours written notice. 5) The window for starting this task shall begin when this agreement is signed and shall end on November 15, 1991, at which time this agreement is null and void. 6) All landscaping and grass shall be returned to like condition. Fences shall be replacedby new eight foot white wood fences to match the existing style. Grass shall be resoded with high quality co~lnon beL~,uda. ?) A sum of $6500.00 shall be paid to Blake SveJkovsky for property devaluation and restrictions of future land use. Including, landscaping, pool installation, deck installation or others. 8) Access to the property after the completion date, shall require fourty eight hours written notice and $100.00 per day.
