Dear Mr. Kingsbury:
I am writing to follow up regarding the issues we discussed related to the
Asbury Manor infrastructure and maintenance concerns.
As you and I briefly discussed recently, it is the City's position that we will
assume the maintenance of the drainage area south of the Westminster
Bridge. The maintenance of the remaining drainage easement through the
area is the responsibility of the Mansions ownership group. We are
developing a plan with the Mansions ownership group to determine how
they will proceed with maintaining the drainage area itself.
The maintenance of the existing retaining walls, screening walls, and
landscaping in the landscape easement poses a different problem. These
structures and landscaping are actually located on property owned by
individual homeowners. As such, the maintenance for these structures is not
the responsibility of the Mansions ownership group. The maintenance for
these structures and the landscaping is the responsibility of each individual
homeowner in that area.
There does seem to be one exception to that scenario, that being the
screening wall and the other improvements that are clearly marked on plats
as being a portion of the Asbury Manor Homeowners Association common
areas. That being said, the vast majority of the screening walls and retaining
walls are on individual property owner's lots. The City will allow each of
the affected homeowners to replace the screening walls with decorative

metal fencing to be placed on their property lines rather than at the setback
line where the brick screening wall now exists. In so doing, each homeowner
would be allowed to increase the size of their yards as well as bring the areas
that have not been maintained properly into their yards as useable space.
It is our hope that the City's willingness to begin maintenance on the
drainage structure south of Westminster as well as our intent to seek
cooperation with the Mansions ownership group will greatly assist in
correcting some of these problems that currently exist today. Furthermore,
we trust that the individual homeowners affected by the screening walls,
landscaping and retaining walls will see the City's willingness to allow them
to enlarge their yards as an acceptable solution to those issues.
