Engineering will prepare such documents in the future, and

that staff and City Council will be aware of such issues.
^dditionally, several programs are being planned for Engineering
and the revamping of some operational procedures resulting
from the restructure Octoher 1. Should you become aware of
other areas which you believe arc similar to this matter, please

GREEMENT FOR SUBDIVISIONS
Steve, in conversation with Taryon, I have been advised that Planning has
been preparing the pro-rata water agreements for subdivisions. That
activity strikes me as being a bit puzzling, as pro-rata instruments are
traditionally municipal engineering department driven. In further
conversation with Taryon, I understand that Russell had assigned her that
responsibility when he acted as her supervisor, and over time Planning has
continued to write these agreements.
I am a bit uncomfortable with that procedure for a number of reasons, not
the least of which is the fact that neither Taryon or me are P.E.'s, and
we are dealing with some technical engineering data. Secondly, it is my
understanding that Public Works is the department of record of pro-rata
charges, which suggests that Public Works would call the shots on all
pro-rata activity, including ordinance preparation.
At any rate, I am enclosing a draft copy of Shadowridge Estates, Phase IV
pro-rata agreement, which was written by Taryon. It is my understanding
that a request to draft this ordinance was submitted to Larry Jackson.
Subsequent to that request, I have been told, Mr. Ratliff instructed Larry
to not draft this agreement and further advised him that City staff
would prepare these instruments in the future. We have complied with Mr.
Ratliff's wishes and forwarded a copy of the attachment to Larry for legal
review.
In the future, I would hope that Engineering would assume this
responsibility because of the Department's knowledge, familiarity, and
expertise in this area. Do you have any problems with Engineering
assuming this responsibility?

RE: INITIATION OF PROCEDURES FOR CREATING A PRO-RATA
ORDINANCE RELATIVE TO SHADOW RIDGE ESTATES FOURTH
!NCREMENT
Dear Mr. Doyle:
Schrickel, Rollins and Associates, Inc., acting as an agent on behalf of Centex Real
Estate Corporation, Lewisville, Texas, respectfully requests that procedures for creating a
pro-rata ordinance for water utility construction associated with Shadow Ridge Estates
Fourth Increment be begun.
The ordinance would address the proVISIOn of approximately 400 L.F. of 12" water line
parallel to Bethel School Road. For clarification, we have attached the water utility plan
sheet for this project.
We are not familiar with the steps involved in the pro-rata ordinance process and would,
therefore, genuinely appreciate any direction that your office might provide. We feel that
the cost of providing this water line should logically be shared by all parties who will
benefit from it, either currently or in the future.
We ure ready to proceed with any requirements associated with the successful completion
of this matter.
