The money to change Freeport from a federal project to a local project will come from the upfront payment that the NTT A will make for the 121 tollway project. That payment has not been made yet. The actions being taken at this time are in anticipation of that payment (not just Freeport, but numerous other projects that will be funded with the NTT A payment). COG reiterated today that January 08 is still the target date. The city had a very good conference call with COG and TxDOT today concerning funding and timelines. The information and timelines are still in line with my 8/1/07 email to Christie Jestis concerning timelines (included below). The 8/1/07 email is the one that I have referred to when discussing Freeport. It looks like we will follow a modified version of Option 3. The actual project should eventually become a local project which will reduce the cost of construction. Also, COG presented several options today that may be available to allow work (design) to begin now and still count against our future 20o~ match on the project. We also discussed options of having the developer design and build the road and still protect the city's interest. Michael Morris asked Christie Jestis to reduce our conference call to a letter and also provide a sample MOU that the city could start reviewing. The city entering into an agreement with COG is mentioned in both Option 2 & 3 in my 8/1/07 email. We are on a very positive path at this time with COG and TxDOT. I noticed on another email that you would like to meet next week. Hopefully by that time we will have Christie's letter so everyone is on the same page. We are in discussions with a developer that has expressed an interest in constructing Freeport and then being reimbursed by the city. Our goal is to ensure that we do not take any action that would preclude us from being reimbursed for the construction of Freeport. The following is my understanding of the general process and the time line to accomplish the de-federalization of the money and having a developer construct the road: Option 1 Keep money federal and eventually get the road constructed (not a good option). Option 2 Wait for the CDA swap to take place in January/February 2008 to de-federalize the money; Then have the City enter into an agreement with COG or TxDOT for the construction; Once the agreement is signed we could then hire a consultant for the design and proceed to construction. 007) Rhonda Adloo - RE: SH 121 MOU Pa If the agreement is with COG, there would be little oversight beyond progress reports. If the agreement is with TxDOT, then we would need to follow all TxDOT rules and procedures.
