Thanks so much for taking the time to include all of the details so I can forward them on to my client, Jerry Daws. This is all very positive news and we appreciate your putting up with all of my questions. It has just taken us a while to get clear on all of the details. I still believe that a meeting with Mr Morris and his associates along with the leadership from Coppell and Republic Property would be the best way for us to collect all of this information, digest it and ask any remaining questions with all of the stake holders present. I am targeting next Friday the 19th for this meeting. But need to confirm that day with Mr Daws. It looks as though everyone except Mr Morris has been copied on this message. If someone could forward this to him to inquire ifhe is available that day, I will try to see ifMr Daws can be available then as well. Thanks again for your efforts and we look very forward to continuing our work with you all. The money to change Freeport from a federal project to a local project will come from the upfront payment that the NTTA will make for the 121 tollway project. That payment has not been made yet. The actions being taken at this time are in anticipation of that payment (not just Freeport, but numerous other projects that will be funded with the NTTA payment). COG reiterated today that January 08 is still the target date. The city had a very good conference call with COG and TxDOT today concerning funding and timelines. The information and timelines are still in line with my 8/1/07 email to Christie Jestis concerning timelines (included below). The 8/1/07 email is the one that I have referred to when discussing Freeport. It looks like we will follow a modified version of Option 3. The actual project should eventually become a local project which will reduce the cost of construction. Also, COG presented several options today that may be available to allow work (design) to begin now and still count against our future 20% match on the project. We also discussed options of having the developer design and build the road and still protect the city's interest. Michael Morris asked Christie Jestis to reduce our conference call to a letter and also provide a sample MOD that the city could start reviewing. The city entering into an agreement with COG is mentioned in both Option 2 & 3 in my 8/1/07 email. We are on a very positive path at this time with COG and TxDOT. I noticed on another email that you would like to meet next week. Hopefully by that time we will have Christie's letter so everyone is on the same page. Hopefully this information is helpful and we can tie up any loose ends when we meet next week. Ken Griffin From: Ken Griffin Wednesday - August 1, 2007 5:03 PM To: Christie Jestis CC: Clay Phillips; Jim Witt; Mindi Hurley; Rhonda Adloo Subject: Freeport Parkway (ST 05-02) Christie Thanks for spending time with me today concerning construction options for Freeport Parkway. We are in discussions with a developer that has expressed an interest in constructing Freeport and then being reimbursed by the city. Our goal is to ensure that we do not take any action that would preclude us from being reimbursed for the construction of Freeport. The following is my understanding of the general process and the time line to accomplish the de-federalization of the money and having a developer construct the road: Option 1 Keep money federal and eventually get the road constructed (not a good option). Option 2 Wait for the CDA swap to take place in January/February 2008 to de-federalize the money; Then have the City enter into an agreement with COG or TxDOT for the construction; Once the agreement is signed we could then hire a consultant for the design and proceed to construction. If the agreement is with COG, there would be little oversight beyond progress reports. If the agreement is with TxDOT, then we would need to follow all TxDOT rules and procedures. Option 3 Request that a TIP modification be placed on an October agenda that would be acted on by the RTC during their November meeting; Then have the City enter into an agreement with COG or TxDOT for the construction; Once the agreement is signed we could then hire a consultant for the design and proceed to construction. If the agreement is with COG, there would be little oversight beyond progress reports. If the agreement is with TxDOT, then we would need to follow all TxDOT rules and procedures. file://C:\Documents and Settings\rbrother\Local Settings\Temp\XPgrpwise\470E909ACit... 10/12/2007 Re: SH 121 MOD Page 3 of 4 Hopefully I have the sequence correct. The city's preference would be to pursue the TIP modification and then enter into an agreement with COG. We understand that the city is still responsible for 20% of the cost of the project. I was under the impression that a meeting was suppose to take place today where this stretch of Freeport Parkway would be taken off of the "federal projects list" could you and Ken educate me a little more about what was suppose to happen today vs January as you mention below? I would appreciate it. Best Regards, Michael C. Our policy body has recently approved an exchange of funding for this project (from federal funds to toll revenue funding). This step is the first phase of the defederalization process. State approval of this change is still pending, with final approval anticipated in the January 2007 timeframe. We are working with the City to make further progress on this project.
