FINANCIAL REVIEW BY: LEGAL REVIEW BY: AGENDA REQ FORM 058808 PEVIEWED BY CM: COPPELT~ PUBLIC WORKS MEMORANDUM FROM: Shohre Daneshmand, Acting City Engineer DATE: December 3, 1990 TO: Alan D. Ratliff, City Manager VIA: Steven G. Goram, Director of Public RE: North Kaye Street Drainage Improvement Status Report On September 10, 1990 Staff began making personal contact with each affected resident adjacent to the proposed drainage improvement on North Kaye Street. Basically, Staff contacted and met with 33 out of 35 residents to provide a status report on proposed drainage improvement, to inform residents of City's need for 10' (+-) of drainage easement, and to ask permission so that a field survey can be conducted. The result indicates the following: North Kave Street and Spanish Moss Court li Residents In Favor of the project, and will grant drainage easement. 29 Residents In Favor of the project, will allow survey. ~ Residents Not In Favor of the survey, and the project. 1Q Residents Will Not Grant drainage easement. Q Residents Mayor May Not Grant drainage easement. According to Larry Jackson, City Attorney, we must have written permission to enter onto one's property. The only other option available at this point is condemnation, due to lack of complete support from the affected residents. This appears to be the only way to make this particular drainage improvement a reality. We respectfully request that this item be placed on the December 11, 1990 City Council Agenda as a status report, and Staff will be available to answer any questions.
