However, as I got deeper into it, I noticed what appears to be a conflict in our Code of Ordinances. Unfortunately, I performed a search through Laserfiche to find out the date of the original ordinance so I could complete this section of the ordinance: WHEREAS, reimbursement to said Developer has been authorized by the Coppell City Council by the adoption of Ordinance No. , passed on or about , which is attached hereto and incorporated herein as Exhibit "B"; and 37 documents popped up. When I started opening them to make sure I found the right one, I noticed what appears to be conflicting ordinances. Chapter 3 entitled "City Departments" Section 3-1- 13 provides information on pro rata but it states you can only collect pro rata on water lines larger than 12". It was originally approved as Ordinance # 180 on May 23, 1978. It has been codified in our Code of Ordinances ever since. Chapter 13 entitled" Subdivision Regulations" Appendix A provides a very detailed, but different, approach to pro rata. It was originally approved as Ordinance 115 on May 15, 1973. The particulars of that ordinance have changed over the years, but it has been codified in our Code of Ordinances. This seems to be taking on a life of its own. I really don't know what ordinance I should be following at this time. I have attached your ordinance with some changes and with most blanks filled in, assuming we can use Appendix A of the Subdivision Ordinance. Help and direction would be appreciated.
