Vista Ridge Retail-CS070629 Ken Griffin - Fwd: Pro-Rata Language From: To: Date: Subject: Attachments: Ken Griffin David Dodd 6/29/2007 4:02 PM Fwd: Pro-Rata Language Pro-Rata Language; pro-rata.pdf David The developer of the Plaza which is north of SH 121 and east of Denton Tap, is requesting to create a pro-rata agreement so he can attempt to recoup some of the money spent on extending water lines to his property. The Plaza developer extend an 8" water line along Highland Drive and SH 121 to provide water to his property. He sent over a sample pro-rata agreement that Pete Smith?? prepared for Piano. Piano's rules are different from ours, so I'm not sure the attached agreement will work for Coppel!. Our pro-rata information is contained in Appendix A of our Subdivision Rules and Regulations. In reviewing the sample agreement, there is a reference made to a prior "facilities" agreement between Coppell and the developer. I'm not sure if that was something that was needed before the water lines were extended, but there is no prior agreement. The property adjacent to the waterlines is now in the process of being developed so I need some direction on how to proceed or if we an even proceed at this time with a pro-rata agreement.
