At the meeting, you requested information on the issue that all parking had to be concrete. I've attached a portion of our Zoning Ordinance (Section 31-2) that addresses concrete parking for non-residential districts. I also spent some time reviewing the history of this development trying to locate a reference to the statement made about "the city said it would be ok to park on the street". I didn't find any reference to that but I did come across several items concerning on street parking. 1) There is a 1985 Declaration of Covenants, Conditions, Restrictions and Easements for Northlake 635 Business Park. I attached the entire document but references to on street parking begin on page 8 in Section 2.11. This section prohibits all parking on public streets. The city does not enforce Property Owner Agreements and Property Owner Agreements do not supercede city ordinances. This was just provided as information. 2) When this development was expanded in 1999,one ofthe conditions of approval was "There will be no truck parking, except behind the screening wall in the designated truck parking areas." When Council approved the expansion on August 10, 1999, it was noted that the parking condition would be complied with (copy of Council action attached). None of the above precludes you from coming before Council and requesting that the "no parking" on Crestside be eliminated. As we discussed in our meeting, you should request to be on the agenda so you will have adequate time to present your concerns and solutions. If you just speak in Citizen's Appearances you will be limited to 2 minutes and receive no Council feedback. If you have any additional questions, please feel free to contact me at your convenience. No antf,nna, satelliL dish or tower shall be erected on any Lot or Improvements for any pur- pose without prior written approval from the Board. Generally, the Board shall grant its approval if such antenna, satellite dish or tower is completely screened on all sides. 2.09 Loadinq Docks. No loading door(s) or dock(s) on any Lot shall be constructed facin9 any streets that are contiguous to such Lot and within or adjacent to the Property. All loading areas shall be designed for reasonably adequate maneuvering of trucKS on the Lot based on the size and intended use of the building planned for construction on such Lot. 2.10 Safe Condition Compliance with Regulations. Each Owner of a Lot shall at all times keep such Lot in a safe, clean and wholesome condition and comply in all respects with all government, health, fire and police requirements and regulations; and such Owner shall remove, at his, her or its own expense, any rubbish of any character whatsoever which may accumulate on such Lot. This includes the maintenance of all grassed and landscaped areas, keeping same cut, trimmed, pruned and swept. In the event any O~ner shall fail to comply with any or all of the terms of this covenant and such failure shall continue for a period of ten (101 days after the Board or the Association shall deliver notice of $ame to such Owner, then the Association and its agents shall have the right, privilege and license to enter upon such premises without liability for any manner of trespass and make any and all corrections or improvements that may be necessary to meet the terms of thi s covenant and to c:harge such Owner the expenses incurred in doing so, including all damages, costs, court costs, and attorneys' fees which the Association may incur in connection therewith. If such Owner shall fail to reimburse the Association within thirty (30) days after reciept of a statement for same from the Association, then same shall be a joint and several debt of all Owners of, and shall constitute a lien against all of, such Lot or other portion of the Property upon which said removal shall have been performed. Such lien shall have the same attri- butes as the lien for assessments and special assessments set forth in Subsection 4.03(j) hereof, which provisions are incor- porated herein by reference, and the Association shall have iden- tical powers and rights in all respects, including but not limited to, the right of foreclosure. 2.11 Parkinq Facilities. No Owner of any Lot shall, nor shall such owner permit his, her or its employees, tenants, customers or invitees, or the employees, customers, and invitees of his or its tenants, to park on public streets wi thin the Property, and NORTH LAKE 635 DELCARATION Page 8 of 23 r ~ it shall be the responsibility of each Owner, his, her or its successors or assigns, or other persons holding under them to provide adequate off-street parking facilities for employees, tenants, customers and invitees on his, her or its Lot as follows: (a) a number of parking spaces for passenger cars shall be provided for as required for the intended use of such Lot by the applicable City of Coppell Ordinance; and (b) parking Lots must be paved with all-weather hard surfaces (asphalt or concrete). 2.12 Curb Cuts. Curb cuts shall be thirty-five (35) feet or that allowed by the Coppell Ordinance, whichever shall be smaller. no wider than applicable City of 2.13 Landscaplnq. (a) Unimproved property. prior to the completion of Improvements on any Lot, and including specifically, without limitation, all times during which Improvements shall be under construction, the Owner of such unimproved Lot shall keep all portions of same visible from any public street <excluding alleys and service drives) together with any unpaved portion of a street right-of-way contiguous thereto (collectively, the .front yard areas.) clean and free of debris and mowed so that at no time shall the grass cover on such Lot, if any, exceed a height of ten (10) inches. In addi tion all such unimproved Lots shall be kept graded suf- ficiently smooth so as to allow such debris removal and mowing and facilitate adequate surface drainage. (b) Improved Property. contemporaneously wi th the completion of Improvements on any Lot, the Owner of such Lot shall landscape all unimproved unpaved front yard areas on such Lot. Such landscaping shall be effected in such manner as shall have been approved by the Board, which approval shall not be unreasonably withheld. The complete landscape plan shall be submitted for the Board's written approval at the same time that plans and specifications shall be submitted. No landscaping shall be implemented unless and until same shall be approved by the Board. No one or more of the Covenants and Restrictions hereby imposed upon the Property shall be amended except by the action of the Owners of at least fifty-one percent (51%) of the total Value of the Property regardless of whether such fifty-one percent (51\) value ownership consists of Declarant alone, Declarant and other Propercy Owners or other Property Owners aloneJ provided, however, that until the Conversion Date, no amendment shall be effective without Declarant's written consent. Any and all duly effected amend- ments shall become effective at the time when executed and acknowledged by the appropriate person or entities specified hereinabove and filed for recording in the County Clerk's office at Dallas County, Texas. 8.06 Notices. Any notice or other communication required hereunder or given in connection herewith shall be deemed received upon the earlier to occur of (a) actual receipt by the intended recipient thereof, or (b) the date three (3) business days after the date such notice shall be deposited in the United States mails, postage prepaid, registered or certified mail, return receipt requested, addressed as follows: (il If the intended recipient shall be the Owner of an unimproved Lot, to the address for the owner of such Lot contained in the appropriate county tax records or, if such Owner shall have purchased such Lot from Declarant, to the address specified as such owner's address in the Deed or other conveyancing document from Declarant to such Owner. The following sets forth our comments. We last reviewed this project October 31, 1986, prior to preliminary plat submittal. If any of the following comments have already been addressed, please advise. Lot and block numbers in written description do not coincide with title block. ( 7 Designate fire lanes on plat. (acting City Engineers) on the referenced project (comment letter dated Jan. 30, 1987, enclosed) and offer the following com m ents: 1. The Lot and Block number of the tract (Lot 2, Block D) are correct on the prints of the Final Plat which are being signed by the owner at this time and are to be forwarded to the City. 2. Your office, during the review process of the Final Plat, indicated that the fire lane was not to be shown on the Plat. The fire lane has been indicated on the approved Site Plat for the site prepared by WSI Architects. 3. There are no open storage areas on this site. 4. A screening wall is being proposed at the northeast corner of the building which would screen the dock area from Crestisde Drive. This wall is shown on the Site Plan. 5. Mr. Steve Goram, Director of Public Works, instructed us that, other than those utilities that are located within the easement dedicated on-site for placement of the water meter, the utilities and storm drainage on this site will not be maintained by the City and will not be located in City easements. 6. Mr. Troy Glidewell, City Fire Marshall, advised WSI Architects that the fire lane turnaround shown on the Site Plan is adequate. 7. Parking for the future building expansion will be provided by the construction of additional parking south of the building. The number of spaces will be required to conform to City of Coppell parking requirements. 8. The major and street drainage systems for the Northlake 635 Business Park were designed using a I DO-year storm frequency based on Technical Paper 25. Since the ordinance was not complete, Ginn, Inc. instructed P&::P to design the park drainage systems based on TP-25, which is used by the City of Dallas and several other municipalities in this area. Because the systems into which this site drains were designed using TP-25, P&::P likewise designed the on-site storm sewer and based site runoff calculations from TP-25. 9. The Site Plan indicates 15' radii to be constructed at both drives. 10. The City Public Works Department and Fire Marshall both reviewed and approved the water and sanitary sewer plan for the site which shows 6" fire hydrant leads. All water lines on-site are to be 811 if they supply a fire hydrant and another water service. 11. A type IIBII headwall as shown in the City of Coppell Standard Details was indicated to be constructed at the outfall of the proposed 24" storm sewer. Because of the relatively slow design velocities in the channel (4.7 FPS) we feel no rip rap on the channel side slope or bottom is necessary at this location. 12. The future parking south of the building has not been designed, and therefore, we do not know at this tim e whether pavem ent will be constructed in the 13' Texas Power &:: Light Co. easement. However, we find nothing in the Subdivision Ordinance, the Final Plat Owner's Certificate, or the document which dedicated this easement, that restricts the construction of parking within the easement as long as Texas Power &: Light has access to the easement for maintenance purposes. This access will continue to be provided if parking is constructed in the area south of the building. 13. The City Subdivision Ordinance, Appendix A, Section III-A-9 states that sanitary sewers shall be constructed of ductile iron or polyvinyl chloride pipe. 14. The City Subdivision Ordinance does state that P.V.C. water mains of 8-inch diameter and smaller shall be Class 200, D.R. 14. Please inform us if your wish any action to be taken on this item. In responding to the issues raised in the Ginn letter, we respectfully wish to point out that the Final Plat, Site Plan, and Engineering Plans for this site have already been reviewed several times by City Staff; and have been approved by the City Staff, the Planning and Zoning Commission and the City Council. The truck court will be screened with an g'-high masonry screen wall along Crestside Drive and the wall drops down to a 6' -high wall along the northern and western edges of the truck court. The screening wall will tie in with the new addition, thus fully screening the truck court area from all adjacent properties. A new electric sliding gate with card operator, opticom device and koox overide will be installed limiting public access to the truck court area. Against the screening wall are groupings of burford holly being proposed to soften the long continuous lengths of wall along the northern and western elevation of the wall. Along Crestside Drive cluster of crape myrtles interspersed with Live Oaks are planned. Around the perimeter of the property plans show Live Oak and Cedar Elm trees to be planted. The new addition will match the existing building material of the existing building that is an exposed aggregate. The plans show a band of smooth finished blue painted concrete on the top third of the building to be continued on the new addition. RECOMMENDATION TO THE PLANNING AND ZONING COMMISSION: Staff recommends approval of this site plan subject to the following condition being met: 1) Submittal and approval of a color board showing all exterior building materials.
