FTTP-CS071104 November 4, 2007 Mr. Trinidad Aguirre Senior Vice President/General Manager Texas Region- Verizon Telecom 600 Hidden Ridge - HQED4H12 Irvfug, Texas 75662 Dear Mr. Aguirre, On August 20, 2007, we sent you a letter concerning an unresolved claim regarding a water leak caused by Verizon when installing the FlOS system on Alex Dr., Coppell, Texas, 75019. Despite some efforts, this issue is still not resolved, and we feel there is. some misunderstanding. With this letter, we hope to update you on the situation so that you can assist us further. Initially, we understand you contacted Klaasmeyer Construction Inc. to brief them on the iSSlle. Klassmeyerthen contactedtheiTinsuraIlre company, CNA, to settle the-issue. Then, CNA sent us an acknowledgement of the new claim. On September 17, 2007, we called CNA to clarify the loss description. We spoke with Beth Stouffer. On that phone call, Beth stated that at the alleged time of the incident, CNA was not insuring Klaasmeyer. She told us that Amerisure Insurance was handling this report, and that we would receive a letter from them. On September 24, 2007 we received a letter from Amerisure Insurance stating that thflY were not insuring Klaasmeyer during the time of the incident either. ' We want to make it very clear that the incident DID NOT OCCUR in February 2007. This is when the leak was DETECTED. The work done by Verizon in June of 2005 w:as the onset of the problem. We have water bills to justify this. We ask that you make a corrected claim (or new one) with the appropriate Loss Date of June of2005. In our initial letter, we made it very clear that the leak had been undetected for several months. Mr. AguiIre - we are asking for your help because we cannot continue to- deal- with insurance companies, construction companies, and other entities refusing to take responsibility. We are enclosing all the correspondence necessary to assist you. Amerisure insured Klaasmeyer until August 1,2006, and therefore the loss at your home appears to fall outside Amerisure's coverage period and is therefore declined. Notwithstanding the absence of coverage for the claim, our investigation of the matter failed to find that Klaasmeyer's activity caused damage to your water service.
