Periodically I go to FEMA's web site to check the status of the submittal to see if FEMA has received all necessary information for
review. I've attached the latest inquiry (12/31/07 @ 9:00 am) which continues to show that the information has not been received
by FEMA to continue the review.
COPPEll, CITY OF07-06-2203P5U5PEND DUE TO FEE OR DATA:
07-06-2203P is the FEMA case number for the study.
In all fairness, I did speak to Mike Boyd (Mr. Hawkins engineer for the study) on 11/28/2007 and he stated that he had resubmitted
all information that FEMA required and it does take several weeks for the information to route though FEMA to the correct person.
However, that does not resolve the floodplain issue until FEMA issues a ClOMR (which authorizes the work to take place - I already
let that work place when the last information was submitted) and the lOMR. The lOMR is the actual document needed that will
remove the property from the floodplain. A developer can not even apply for a lOMR until he has performed all the work he said
he was going to do under the ClOMR (which we don't currently have). The lOMR includes additional information submitted back to
FEMA that everything was completed correctly and it also includes geotechnical information that all work is correct. I also have the
certify that all work was completed correctly.
Even if Mr. Hawkins had a ClOMR and completed all fill today and had all the geotechnical information and I came in to work from
my vacation today and signed it, it's doubtful that he would receive the official lOMR in time to file this plat. That's the reason that
I suggested that he only final plat the lots out of the current floodplain. If he continues and desires to plat all lots at this time, he
must show the current floodplain. The current floodplain is the only legal and official floodplain that exists at this time. I can not
assume what some future action of a federal office (FEMA) will be.

I just received a written response from Mr. Hawkins to staffs DRC Comments (see attachments) where Mr. Hawkins states that
there is no longer a boundary dispute or a flood plain issue. Ken and I will work out the appropriate response on the flood plain
issue.. but what about the boundary dispute??

Attached is a letter I just received from the attorney representing the property owner abutting Alexander Court to the west,
apparently there is an on-going boundary dispute.
What involvement, if any, does the city have with this?
