Dear Ken:
This letter serves as notice that Duke Construction takes full responsibility for all risk associated with offsite
grading operations related to the aforementioned site. Duke shall hold the City of Coppell hannless of all
responsibility related to such activities. Duke has every intention of completing the offsite grading to allow for
positive drainage of the site and to prevent the creation of low areas that would hold water during rain events.
This being said, it is the request of Duke that the final acceptance of Dividend Drive, Point West Blvd and the
associated utilities be issued with the understanding that offsite grading activities will be ongoing.
