Typically, construction isn't started until a final plat has been submitted to the City for approval. In this case, one more time, we were trying to work with the developer to expedite the construction so we let him proceed once the preliminary plat was approved. The preliminary plat was approved by Council on June 12,2007. By ordinance, the preliminary plat is only good for 9 months. That means that the preliminary plat will expire on March 12,2008, unless the final plat has been submitted to the City for approval. We are over 5 months into the 9 month period and no final plat has been submitted. I am starting to get concerned because without a final plat approved and filed for record there is no right of way or easements for the streets or utilities currently being constructed. And, obviously, no building permits could be obtained for any structures. I would like to send Mr. Hawkins a letter (either from me or Planning or our attorneys??) notifying him of the approaching time line for the expiration of his preliminary plat. Hopefully, we would receive some feedback concerning when he will submit his final plat. However, with the ongoing lawsuit, I'm unsure if we should contact him directly, through our attorneys or not at all. At this time, I'm looking for direction on how I should proceed. I know he (or his partner) noted that on written notes. As far as I'm concerned, we should shut Hawkins down and maybe that will get his attention! (Thought I'd send it anyway, even after our conversation) Now I feel better!
