Mills Lane) Dear Mr. Doyle: In response to the comments. above referenced item we offer the following In conversation with Ms. Taryon Bowman it is our understanding that the requested map and traffic study will be provided to both Mr. Ratliff and yourself via the distribution of the P&Z packets. Ms. Bowman and I discussed this request and felt that since she was already generating this information for the May 18, 1989 P&Z meeting that she could distribute an additional packet to Mr. Ratliff thereby handling this request internally. It is our understanding that the concerns presented in your handwritten memorandum dated 5-7-89 have been resolved per our conversation with Ms. Taryon Bowman. Regarding the half-road issue for the 24 foot dedication we offer the following observations. We do not feel there is a half-road issue since this drive is intended for future bus access only to the High School site. No thru traffic to businesses or residences are intended to use this driveway primarily because it will only connect to the school property. The width of drive needed in the future shall determine how much additional right- of-way to the north must be obtained from ABQ Development Corp. in the future. It is our understanding that ABQ Development Corp. has already agreed to dedicate the necessary right-of-way to accomodate this drive whenever it is needed per their agreements with the CISD. AS I recall, you said that when you complete those two projects, you would pursue the construction of the drainage structure(s) just west of the Connell Skaggs Addition. I was concerned about the situation, because during the July 12, 1988, storm, property had flooded along Shady Dale Lane. At a later time, you said something about needing easements. [{ave you gotten them yet? [ have heard since then thai there was some resident ~al flooding. Likewise, it has come to my attention that per the attached letter, dated May 20, 1987, to Wayne Ginn, P.E., the City Enginee~ at that time, that was part of the City Council request packet tot snbject plat, you cormqitted to bnih]ing the drainage structure(s) "simultaneously w~th the school construction of same, and acco[ding to City Specifications". Therefore, since the school construction is nearing completion, the drainage structure[s) shall De constrncted. Please forwa~(l three (3) sets of construction documents for revLew and approval. When those sets are finally approved, it will he necessary to submit at least six (6) sets of construclion documents for linal review aod stamped approval. The Board ha given me every indication that there will be no problem with the vote, although the Board will not meet to act on that matter until May 8. I should, however, also make note that there are presently no funds available to use on construction of the street. As we had discussed earlier with City staff, it would be our plan to consider construction of a road for bus usage when the second phase of the school is begun. You might recall that a traffic study was done in conjunction with the construction of Parkway Boulevard and the access road to the school property. That study showed that two lanes would be adequate access to the school until further .additions were done. We are, however, constructing both sides of Parkway Boulevard and are constructing a four lane, 44-foot wide street section from Parkway to the school. We are comfortable, and traffic studies show that this street should be adequate for many years. Shadydale Coppell, Texas 75019 Dear Mr. Dunn: A few weeks back I spoke with you concerning the chain link fence~ you erected at your property. I explained to you that it looked as though the fence was encroaching on the Willow Lane right-of-way and also the Shadydale right-of-way. I also informed you that we could find no record of the issuance of a fence permit for your property. You explained that the fence material was new, but that the fence had existed along Willow Lane and Shadydale for several years. I told you that unless the property lines were surveyett, I would not take any action concerning the location of the fence. Recently questions were raised concerning the fence location because of the storm sewer project that is being undertaken by the Coppell Independent School District and the Connell/Skaggs joint venture. Construction personnel found that they would be unable to extend the storm sewer to the south end of the Willow Lane right-of-way because the fence you constructed was in the right-of-way, according to their figures. Because of the questions involved with the fence location, it was decided to employ the services of a registered surveyor to locate the northeast and northwest corners of your property. I spoke with you on October 8, 1987 and requested your permission to have the surveyor to attempt to locate the property pin on the northwest corner of your property, since the pin was believed to be within the chain link fence. You agreed to allow the surveyor to check within the fenced area. The property pin was found. When the pin was found it was observed that it was approximately five feet within the western fence boundary and approximately twelve feet within the northern fence boundary. The right-of-way for Willow Lane and Shadydale does extend to the property pins, therefore, the fence is encroaching approximately twelve feet into the Willow Lane right-of-way and encroaching approximately five feet into the Shadydale right-of-way. When the northeast property pin was located, it was observed that the eastern most portion of your fence was encroaching approximately thirty feet into the Willow Lane right-of-way. The surveyor who uncovered the property pins was also the same man who surveyed that area approximately fifteen months ago. The surveyor informed me that when the survey was made, fifteen months ago, that he made field notes of all existing fences. He could not remember any fence that was located on your Mr. James Dunn Page Two property at that time. The field notes also did not mention any type of fence. As I informed you when we met a few weeks ago, a fence permit is required to be issued prior to the construction of any fence. I also told you that fences were not allowed to be located within the front yard of any lot. Because there was no documentation of when the fence was constructed, I chose not to pursue the above points. Now that it has been determined that no fence existed fifteen months ago, the city must require that this new fence be brought into compliance with existing ordinances. In order for the fence to comply with existing ordinances, the following items must be accomplished. 1. The fence must be made to terminate at the front of your house. Fences are not allowed to extend beyond the front of the house according to Section 9-2-6 C of Ordinance 86-350. Z. The fence must be moved out of the Willow Lane right-of-way. No fence may be constructed upon any public property according to Section 9-Z-5 of Ordinance 86-350. A street right-of-way is considered public property. 3. A permit must be issued for the fence. The permit must include a plot plan of the property showing the location of the fence. The cost for this permit is $10.00. This fence must be brought into compliance, as listed above, or removed no later than October 30, 1987.
