Dear Inspector O'Dell,
RE: Vehicle Damage: Repair Cost $2,255.65
Insurance Payment - 2.010.65
Claim Amount $ 245.00
Please review the enclosed file and pictures with concerned personnel responsible for
payment of damage claims and instruct them to process and pay the claim amount of
$245.00 which was our deductible.
We were indeed thankful no serious injuries resulted because of the incident. Limited
"loss work time" resulted even though a full week was required for repair of the car.
I was able to use my wife's car for the week so a car rental was not necessary.
We continue to get the "run-a-round" from both Tiseo Paving Company and Dallas
Light and Barricade. Mr. Shane Howell of Dallas Light and Barricade states this was
"An Act of God". That statement is not true as God had nothing to do with it. Had the
sign been properly anchored with enough sand bags it would not have blow over into
Bethel Road hitting the hood of my car and bouncing into the windshield. Shane also
said "that when we entered the construction zone we entered at our own risk". I have
never heard of such a thing nor as I turned onto Bethel Road did I see any signs or
notification of any kind to indicate we were entering or traveling at our own risk.

Sergeant Moore,
After you interviewed me on Tuesday October 23rd prior to our visit to
the accident site did you have a chance to make an official "Police Report"?
And if so, how may I secure a copy?
We are getting a "run-a-round" from Tisco Paving Co. and the "Light and
Barricade Co." as they stated they are not responsible for" Acts of God"
plus the fact we were told when we enter a construction zone we enter at our
own risk. This was not an "Act of God" it was the Light & Barricade fault
as they did not properly secure the temporary sign with enough sand bags to
hold it in place. Also as I entered Bethel Road I did not see a sign posted
that said we entered a construction area at our own risk.

I hereby authorize the repair of the vehicle as described in this Repair Order. 1 agree that Service King is not responsible for loss or damage to this vehicle and/or articles
left in the vehicle, due to fire, theft or any other cause beyond its control or for any delays caused by the unavailability of parts or shipping delays.

be contacted for authorization of any additional repair charges. If new parts listed in this repair order are not available, Service King reserves the right to repair such

Terms: The total amount of the repair charges must be paid before the attached vehicle can be released for delivery. If insurance coverage pays either a portion

that I must make arrangements with any lien holder or other payees to endorse the insurance check/draft prior to the release of the repaired vehicle as described.
