Date: July 13, 1993 For some time now the City has been negotiating with Mr. Don Carter and Mr. Jay Riney for the acquisition of temporary construction easements across their property. The total square footage of the easement the City has been trying to obtain is 77,898 square feet. This easement in essence extends from Moore Road westward to Grapevine Creek (see attached exhibit). On June 6th, 1993, the contractor, my inspector, Mr. Jim King (representing Mr. Carter) and myself walked the project to determine the extent of tree removal and potential damage to the property. The first 1500 feet of Mr. Carter's property had various trees where the City would have to remove limbs and in some cases entire trees, but in all cases it was sporadic on the removal of the trees. To install the sewer line on the west 300 feet of Mr. Carter's property and across Mr. Riney's property would necessitate the removal of ever tree within the easement. Even with the removal of all the trees, it was still questionable whether or not the contractor would have adequate space to stock pile materials and access the project. In essence, to open cut to install the sewer line would necessitate the removal of approximately 30 to 35 trees and would entirely change the view of the property. Immediately south of Mr. Riney's property, the City had already bid the project to begin the micro-tunnelling process from the north side of Grapevine Creek to the west side of Denton Tap Road. This includes micro-tunnelling the entire stretch of Bethel Road in the Creekview Subdivision. It is doubtful that Mr. Carter will be willing to negotiate with the City on the acquisition of the easement if the City holds to its position of open cutting the last three hundred feet of Mr. Carter's property and removing every tree in that area. However, after a meeting on July 7, 1993 with Mr. Carter, there is an indication by Mr. Carter that he will grant us a temporary easement, grant us the ability to move the sewer line to avoid some of his other trees and then grant us a new 20 foot easement over the top of the new sewer line and allow us to remove trees and branches on the east side of the property as necessary to install the line if in return the City will micro-tunnel the last 300 feet of his property and the 300 feet on the adjacent property thereby saving all the trees in this area. The cost to micro-tunnel this project $101,308.00. Currently, the section of the sewer line installation from MacArthur to Moore Road has basically been completed. This is about 37% of the entire project. As of yet, the City has encountered no unusual situations or circumstances which would necessitate a change in the scope of the project. Council may recall that when this project was awarded I indicated that there was a strong potential for various change orders throughout installation of this project due to the complexity of the project and the unknowns encountered dealing with the construction of the project. The Engineering Department's recommendation is to approve Change Order # 3 in the amount of $101,308.00 to micro-tunnel an additional 589 feet on this project. Mayor Pro Tern Robertson moved to approve Ordinance No. 93607 designating Minyards Foods, Inc. Tax Abatement Area as Reinvestment Zone No.1 (TAR-I); pursuant to Section 312.201 of the Property Redevelopment and Tax Abatement Act, said area being the property owned by Minyards Foods, Inc., and described as Tract 1, Abstract 1439, consisting of 62.528 acres, located at the southwest comer of Freeport Parkway and Bethel Road in the City of Coppell. Council member Mayo seconded the motion; the motion carried 6-0 with Mayor Pro Tern Robertson and Council members Weaver, Stahly, Reitman, Mayo, and Garrison voting in favor of the motion.
