Great work Ken. Much appreciated. I will be talking with Dave Littleton tomorrow and I look forward to receiving
the agreement from your attorney.
In the interest of expediting the process further, we are still looking to the City for any language that they would
require to be included in our future construction contracts. In addition, we need a copy of the Grant Funding
Agreement (perhaps from Mindi Hurley, and only if it is still part of our new contract).

I spoke with Jerry Bates of Oncor/TXU today concerning the relocates on Southwestern. He stated that
after further review, they will be relocating the utilities in the right of way at no cost. He did state that
the utility line that goes through your property would be relocated at your cost. He also suggested in
may be in your best interest to wait to relocate the line through your property until you have some
proposed load to place on the system. He stated that sometimes if a commercial development is going
to be a big user of electricity, that TXU may work with them on a reduced cost to relocate. There are
no guarantees, but it may be worth considering.
Jerry also stated that he thinks any work they have done up to this point is still valid and should not
slow down the relocates. He will have Jeff Curry (he's the rep from TXU that we deal with on
relocates in right of way) call Keith Marvin to discuss the timing from this point forward. Until Keith
and Jeff make contact, I really don't have a time line on when the relocates will take place. I did tell

Jerry Bates that the intention was to begin construction this June.
As far as the agreement goes, I've been told that we should expect a revised agreement from our
attorney by the first of next week.
