ST0003-ES071026 THE.CiTY.OF COPPELL /~ ,~, October 26, 2007 Shannon Olmstead 534 Cooper Lane Coppel], Texas 75019 RE: Coppell Road Reconstruction ST 00-03 Parcel 5 -- Sidewalk Easement Dear Mrs. Olmstead: The City of Coppell is in receipt of your letter of September 30, 2007 in reference to the reconstruction of Coppell Road and our request for acquisition of a sidewalk easement across a portion of your property. We appreciate your response, and I will address your conccms in the order in which you present them. I. The three bushes at the northwest comer of Cooper Lane and Coppell Road are not in conflict with the proposed construction. As was discussed, the sidewalk construction may require substantial trimming of the bush closest to the intersection of Coppell Road and Cooper Street. We will replace this bush if it doesn't survive the construction. I The photinias within your fenced yard will not be disturbed during the construction of this roadway. 3. The 6' wooden fence along your property line will not be disturbed during this project. The City of Coppell requires contractors working on our projects to photograph and videotape all fences, drives, landscaping, mailboxes, and any structures within the \vork area prior to commencing work. This allows the city, as well as the adjacent property owners, the opportunity to review this documentation to determine if damage was caused during construction, or whether it \vas present prior to commencing the work. Any damage caused by our contractor during the course of the project will be repaired at their expense prior to the city paying the final bill for the project. 4. The City of Coppell does not own the power poles along Coppell Road. We have initiated the proper requests for these utilities to be relocated as required for the project. These trees are over 20 feet away from the proposed back of curb. They should not be impacted by this construction. 6. The City of Coppell has a noise ordinance that is in effect at all times. We will expect the contractor to be in compliance with this ordinance during this project. The name and phone number of the city inspector will be provided during the project for any issues that may arise during construction. 7. Cooper Lane will be lowered approximately two feet at the intersection of Coppell Road. This change will require the reconstruction of 50 feet of Cooper Lane. The street will be lowered approximately 1.5 feet where your driveway intersects it. This is why we need to rebuild 25 feet of your driveway. The grade will be steeper than it is today, but the steepest section will remain the drive approach that will be built to the city standards which is typically 8.3% slope. 8. Coppell City Code (Sec. 9-8-1) requires property owners to maintain the parkway within 15 feet of their property. The section along your west property line will be no different than the 11 feet between your south property line and Cooper Lane. The city has maintained the drainage ditches along Coppell Road. Once the ditches are no longer there, the adjacent property owners will be expected to maintain the area. This project will be of great benefit to the citizens of Cop pel I. The enhanced accessibility to the schoo] and the Old Town area the proposed sidewalks will offer has been needed for quite some time. While we understand your concerns, we cannot agree to some of the concessions you are requesting. As a reminder, we are simply asking for dedication of a sidewalk easement across 12.5 square feet of your property for which we are offering compensation in the amount of $500. Sincerely. ').'.
