Utility Conflicts
Dear Mr. Smith:
I am in receipt of your letter of June 12, 2008 regarding utility conflicts and your request
for additional time on this project. The General Provisions of the North Central Texas
Standard Specifications for Public Works Construction as well as the Special Provisions
address the issue of unknown utilities. These provisions clearly state that the city can not
be held liable for any additional work unless a conflict requires the building of special
work. As difficult and time consuming as it may have been to identify and locate these
utilities, it does not warrant additional compensation, or granting of additional time under
the provisions of the contract.
The utility poles on the south end of the project do not appear to be in conflict with the
proposed water line location. The water line appears to be from one to three feet away
from the existing poles as scaled from the plans (edge to edge). The city inspector can
work with your sub contractor to meander this line at the pole locations as necessary to
complete this installation.
Any request for additional time will only be granted upon demonstration that the delay
has caused an adverse impact to the critical path in accordance with provision 1.36.
