Re: Home Rule Charter Section 11.06
Dear Ken:
Pursuant to your request, the undersigned provides the following opinion relating
to whether Section 11.06 of the Home Rule Charter of the City of Coppell prohibits the
City from engaging Bill Anderson of Dan Dowdey & Associates to design the drainage
improvements for the Barbara Austin property at the northeast corner of Sandy Lake and
Moore Road.
Section 11.06 of the Home Rule Charter prohibits an employee or consultant of the
City to provide services for compensation directly or indirectly to a person or organization
seeking approval, investigation or determination from the City. If Bill Anderson or Dan
Dowdey & Associates is providing services for compensation directly or indirectly to
Barbara Austin, the City may not engage Mr. Anderson or that company to design the
drainage improvements for the subject property if Barbara Austin is seeking approval or
determination from the City. This does not preclude Barbara Austin from engaging Bill
Anderson of Dan Dowdey & Associates to design the drainage improvement at her cost,
nor does it prohibit Bill Anderson or Dan Dowdey & Associates from assisting the City
Engineer without cost to the City in the design of the drainage improvements for the
subject property.
