RE: Drainage Utility District Concept Date: May 12, 1995 This work session item is to provide information for possible revenue to help address drainage issues. House Bill 1567 of the Texas Legislature authorizes municipalities to establish a ,,bmunicinal draina~,e utility system" which "may be. funded and fees in support of the system may [._dcwN'~e assesst'ed, levie~ and c~llected." c. xc~ c'/[~k ,KX~, 5xe~To establish the utility, a city mast: .1. Establish a schedule of drainage charges against all real (existing) property in the ¢,~f, ,,~,~ municipality, 2. Provide on nondiscriminatory, reasonable, and equitable terms drainage for all real property in the municipality (upon payment of charges). The funds collected must be segregated and completely identifiable the City's accounts if designated for future system improvements. However, numerous expenses may be funded in this manner, such as: 1. Cost of acquisition of right-of-way or easements, 2. Cost of engineeringjlegal and related services to design the projects, 3. Cost of construction, repair and maintenance of structures, 4. Cost of equipment and facilities to provide maintenance of drainage structures, 5. Cost of debt service, 6. Cost of administration.
