Storm Water Utility Program Billing
I have reviewed the applicable statute and case law regarding who may be billed
for the levy to finance the drainage utility system. Although the statute does not address
the issue, it is our opinion that the owner of the property should be billed and not the
renter or tenant of a property owner. Consequently, it is our recommendation that the
City devise a system to bill owners independently from a water bill if the water bill is being
addressed to a renter as opposed to the owner of the property.
