The City Attorney has reviewed this situation regarding the flooding conditions which have occurred and continue to be a threat and has found this situation does meet the require- ments of an emergency, to warrant the entering into a contract without the necessity of going through the usual bidding procedures. B. ~ Dece~er 13, 1988, the City Council authorized $35,000 for the investigation and im- provements to reduce flooding for the two areas on Bethel School Road and Pelican ~ne. Since then, engineering investigations have resulted in the reco~endation of a need for more improvements than originally anticipated. Surplus CIP Funds are available for these improvements. Ratliff, City Manager From: Frank Trando, Deputy City Manager/Finance Director Subject: Additional Funding for the Pelican Drive Drainage Problem On March 28, 1985 the Council entered into an agreement with Dallas County to overlay Thweatt Road, Bethel Road and Deforest Road. By entering in this contract we saved approximately $103,700.00. We also entered into an agreement for them to overlay Southwestern for a cost of $13,200.00. Consequently we ended up with a savings of $90,500.00. I propose that $65,000.00 of the savings be added to the $35,000.00 originally appropriated in December of 1988 for the correction of this drainage problem. Doyle, P.~~~ Engineer RE: SPECIAL REPORT ON MILESTONE DATES FOR PELICAN/BETHEL SCHOOL ROAD DRAINAGE IMPROVEMENTS This report provides the results of a meeting with Mayor Wolfe, various residents (see attached attendance sheet), and Staff on Thursday, June 8, 1989, at 9:00 a.m. in the Town Center Executive Conference Room. The meeting was called in response to a letter (copy attached) dated May 11, 1989, to Mayor Wolfe from Mr. David Bain, and after flooding of homes again the previous day. After discussion on the progress of the project's design and administration, or the lack thereof, it was resolved that the project would follow a time line as attached, and Mr. Bain has also furnished the timeline, (see attached). When coordinating with Wayne Ginn, on Monday, June 12, 1989, to receive the advertisement to be published on Friday, June 16, 1989, Staff determined to pursue a first track method moving award of bids up two weeks (i.e. to be awarded on June 27, 1989, instead of July 11, 1989). It was determined not to notify others involved until the bids were received, etc. The agenda request sheet for the declaring of an emergency and recommending the award of a contract for the construction of these drainage improvements will be provided today. Wayne Ginn will take bids on Wednesday, June 21, 1989, at 2:00 p.m., and will present them to Staff on Thursday, June 22, 1989, at a meeting to be set up for that purpose. I hope this provides the pertinent information from the June 8, 1989 meeting, the direction from it and how Staff is proceeding. If there is any additional information needed, please let me know. Box 478 Coppell, TX 75019 Re: Bethel School/Pelican/Blue Jay -- Drainage Dear Mr. Ratliff: Prior to the recent heavy rains in May and June, our firm prepared an Engineering Report analyzing the problem and recommending proposed improvements to help alleviate some of the flooding along Bethel School and Pelican Lane. A subsequent meeting with the homeowners indicated a need/desire to add some additional storm sewers above what was recommended in the report. Due to the fact that residential property was flooded and that public health is at risk, we have taken the liberty to negotiate a proposal with SYB Construction Co. for the construction of the storm sewers. This proposal is presented for your consideration. If the City Council elects to declare an emergency and award the contract, this will expedite the construction by about 4-6 weeks. As a matter of record, it must be noted that the construction of the additional storm sewers will not guarantee the homes will not be flooded again because some of the floor slab elevations are below the top of this curb. The property owners must remove fences and other obstructions to allow for positive overflow between the houses. We are available to discuss this matter at your convenience. Sincerely, H. Bethel School/Falcon The existing intersection has 4 standard 10 foot inlets. Proposed improvements include the addition of 5 standard 10 foot inlets and 1-20 foot inlet. This will nearly triple the inlet capacity in this location. Estimated cost based on the base bid is $28,427.00. B. Pelican Lane The existing street has 2 standard 10 foot inlets. Proposed improvements include the addition of 2 standard 10 foot inlets and 1 standard 20 foot inlet. This will triple the inlet capacity in this location. An easement will be required. The estimated cost based on the base bid is $36,002.00. C. Blue Jay/Pelican There are no inlets at this location and standing water ponds on the north east side of Pelican. Proposed improvements include the installation of a small grate inlet on the east side to dry up the ponding and 1 standard 10 foot inlet on the west side with a 30 inch storm sewer outfall. An easement will be required. Estimated cost of these improvements is $12,360.00. D. Alternate Bids Alternate bids were analyzed for the Bethel/Falcon and the Pelican Lane location. The alternates were for the construction of additional inlets and the extension of the outfall storm sewers. These alternates add $39,185.00 to the total cost of the project. After thorough review, it is our opinion that the added benefits do not justify the extra cost. Therefore, we recommend that only the base bid items be constructed. E. Homeowners Responsibility It is of utmost importance that the homeowners remove the obstructions that prevent the positive overflow when the inlet capacity is exceeded. F. Contractor S.Y.B. Construction Co. is the same construction company that is building the inlets on the Denton Tap Road project. They will be bonded for this project with performance and payment bonds. They have assured us that their prices are sufficient to completely restore the area to its original condition. They come with good recommendations. G. Proposed Budget A. Those persons speaking were Mr. Joe Brehm, 832 Woodlak~. Mr. Brehm, representing the Villages of Coppell, spok~ concerning the safety requirements on the fencing of lakes in the Coppell area. Mr. Brebm stated that although he was concerned with safety, he did not like the idea of a fence in these areas. Mr. Joe Nave, 550 Shadowcrest Lane, President of the Coppe11 Exchange Club, was present to invite the City Council to participate in the upcoming July 4th parade and indicated to the Council that they have already begun work on the parade planned for next year. There will be fun and games following the parade which will be held in the Corners of Coppell Shopping Center. Mr. Don Markey, 529 Meadowview Lane, spoke to the Council regarding his feeling of confusion concerning the City's Building Code. Mr. Markey stated that it was his opinion that the Codes need to be clarified so that the average layman can understand what is required. Additionally, Mr. Markey stated he felt that members of the Board of Adjustments are not reflecting the feelings of the City Council. Mr. Markey's item that was presented before the Board of Adjustments will he coming back in July for reconsideration. Mr. Peter Safronoff, 534 Meadowview Lane, also spoke and stated he echoed the comments concerning the City's Building Codes presented by Mr. Markey. Mr. Safronoff indicated that it was his feeling that the information received concerning the recent hearing of Mr. Markey was not clear and that the actions of the Board of Adjustments had been arbitrary and capricious. Item 7: Swearing in Ceremony of newly appointed Library Board member and Planning and Zoning Commissioner. Mayor Wolfe requested Valerie Jarvie, recent appointee to the Library Board, and Robert Scott, appointee to the Planning and Zoning Commission, to come forward. Mayor Wolfe then swore the two (2) members in and welcomed them to their terms of office which is to fill unexpired terms ending September 30, 1989. Item SA: Discussion and consideration of a motion declaring an emergency, exists because of flooding, sufficient to warrant expenditures of funds without the usual bidding procedure in order to give relief to citizens and preserving public improvements of the City of Coppell. Following discussion on this item Councilman Morton moved that an emergency be declared to warrant expenditures of funds without the usual bidding procedures. Councilman Smothermon seconded the motion; motion carried 7-0 with Mayor Pro Tam Wilkerson, Councilmen Thomas, Morton, Smothermon, Cowman, Robertson and Nelson voting in favor of the motion. Item aB: Authorizing for the expenditure of funds not to exceed $65,000 for the Bethel School Road/Pelican Lane drainage improvements from surplus CIP Funds. Consulting Engineer Wayne Ginn made the presentation to the Council. Mr. Ginn indicated that in his report he has recommended that some fences be removed to help alleviate the flooding problems in the Bethel School Road/Pelican Lane area.
