A RESOLUTION OF THE CrlY COUNCIL OF TI~ k;lrY OF COPI~ELL,

CRAIG OLDEN, INC. FOR EMERGENCY SLO~PE STABILIZATION
CONSTRUCTION ON GRAPEVINE CREEK; AND PROVID]~qG A.N EFFF, C'I'IV~

WH'~:REAS, Article 1-5, Section 1-5-6G of the Code of Ordinances of tim City of
Coppel], Texas authorized expenditures exceeding FiReen Thousand Dollars and No/100
($1 $,000) in the event of an emergency declared by the City Manager and approved by tb.e City
Council; and
WHEREAS, the City Manager has declared that an e, merge~y exists with repel to the
slope stabilization construction work on Grapevine Creek Phase II as descn~oed in RFQ #1572,
and is further described in the contract with Craig Olden, Inc. attached hereto as Exhibit "A"; and
WwIr~REAS, the City Manage~ and the City Council find that a procurement for the
aforesaid construction is necessary to pres~ve and protect thc public health or safety of the
residents of Coppell and because of public c~lamity e~ist~ that requires the immediate
appropriation of money to relieve the nec, e~ty of the residents of Coppell and to preserve the
property of the City; and
WHEREAS, thc City Council of the City of Coppell, Texas approves the declaration for
the emergency expenditure by the City Manager, and
WIIEREAS, the City Council desires to authorize the execution of the Contract by and
between the City of Coppell, Texas end Craig Olden, Inc. dated April 26, 1997 attached h~reto as
Exhibit
NOW THEREFORE, BE IT RESOLVED BY Tl~ CITY COUNCIL OF ~
CITY OF COPPELL, TEXAS:
SECTION 1. That the City Manager of the City of Coppell, Texas d~clarez that the
emergency exists as to the necessity for certain soil stabili tion construction on Csrapevine Creek
as further described in RFQ# 1872 and in the Contract by and between the City of'Coppell, Texas
and Craig Olden, Inc. attached hereto aa Exifibit "A".
SECTION 2. That thc City Council of the City of Coppell, Tenas approve~ tbe
emergency declaration made by the City Manager and finds that a procur~nant is nece, s~ to
preserve or protect the public health and safety of the residents of Coplmll and becaus~ a public
calamity exists which requires the imm~liatc appropriation of the mon~J to relieve tim nec, e~nity
of the residents of Coppell and to preserve the proimrty of the City.
SEL-rlON 3. That the City Manager is authoriz~ Io execute the Contract by and
betw~em the City of Coppell, T~xas and Craig Old,t. Inc. attached h~-to and marked Exhibit
SEC-I'iON 4. This resolution shall become effective immediately from and atom' its
passage, as the law and charter in such cases provide.
