RE: Broken Irrigation

Dear Mr. Laughley:
The City of Coppell has been made aware of the broken irrigation system for Duke-
Freeport propel1ies, which remains to be an issue that needs to be repaired. This has been
an ongoing issue for several months. After three different meetings with you and
different irrigators there has been nothing done to fix the problem. We are holding your
final payment until this matter is handled. We are giving you till April 3, 2009, to have
your crew on site making the repairs or we will hire a contractor to complete the work
and back charge your company. The panels need to be repaired under the Maintenance
Bond. Once you uncover the cause of the irrigation leak, if you feel it is damaged at no
faul t of your company contact Al bert and you will be paid for any extra work done, if it is
agreed that the damage was made by others.
