WHEREAS, the pity Planning and caning aission and the governing body of
the pity of appell, Texas, in carnplince with the laws of the State of Texas, have given
requisite notices by publication and otherwise, and after holding due hearings and affording
a foil and fair hearing to a1~ property owners generally, and in the exercise of legislative
discretion have concluded that the Subdivision ordinance should be amended.
NOW, THEREFORE, BE IT I~RDAINED BY THE I~ITV I~oUNII~ of THE I~ITY
HF I~OPPELL, TEXAS:
SEI~TION I.. That the ubd1v~s1or~ ~rd~nar~ce of the pity of oppell, Texas, as
heretofore amended, be, and the same is hereby, in part, amended by amending Section III,
paragraph 2b, to read as follows:
"~G, Parking Space is an enclosed or unenclosedall-weather surfaced area not on a public
street or alley, together with an all-weather surfaced driveway car~netin the area.
with a street or alley permitting free ingress and egress without encroachment on the
street or alley. Any paring adjacent to a public street wherein the maneuvering i~
done on the public street shall not be classified as off street parl~ir~g in computing the
paring area requirements for any use."
SECTION ~. That the Subdivision ordinance of the pity of oppell, Texas, as
heretofore amended, be, and the sane is hereby, in part, amended by amending exhibit A,
Appendix , Section I, Subsection E, Paragraph 1, Subparagraph k, to read as follows:

ETI~N . That should any sentence, paragraph, subdivision, clause, phrase or
section of this ordinance be adjudged ar held to be unconstitutional,111eaX or Invalid, the
same shai~ not affect the validity of this ordinance as a whole, or any part ar provision
thereof other than the part so decided to b unconstitutional, illegal or invalid, and shall not
affect the validity of the subdivision ordinance as a whole.
CTII~N 4, That all provllons of ordinances of the pity of appeli, Texas, in
ca~f 1~ct v~th tl~e prov~slans of thl~ ordlr~nce he, ar~d the carne ~.re ~iereby, repealed, and alb
other provisions not in conflict with the provisions of this ordinance sha11 rerrlain in fuiZ
force and effect.
ETI ~, That an offense committed before the effective date of this ordinance
is governed by the prior law and the provisions of the Subdivision ordinance, as amended,
in effect when the offense way committed and the former law is continued in effect far this
purpose
ETIDN ~ That any person, flan ar corporation violating any of the provisions ar
terms of this ordinance shall be subject to the same penalty as provided far in the
Subdivision ordinance of the pity of oppell, as heretofore amended, and upon conviction
shall be punished by a fine not to exceed the suln of Five Hundred Dollars ~aa,a0} for
each offense; and each and every day such violation shall continue shall be deemed to
constitute a separate offense,
S~TII~N 7. That thrs ordinance shall becolne effective immediately from and after
Its passage and the publication of the caption, as the law and charter in such cases provide.
