WHEREAS, the City of Coppell has requested the Commissioner of District No. 1 to
.perform asphalt overlay of Wrangler Street, Sanders Loop and Loch Lane; and
WHEREAS,. the estimated cost for the work is $57,367.94 and
WHEREAS; the 'City of Coppell has escrowed $57,367.94 in Escrow Fund 120 - 763 -913 -7 for
.100% of=- the cost of the work on the Type E road per the attached City /County
Agreement and
WHEREAS,- �the ,;;...City of Coppell has executed the attached City /County Agreement
f^ :authorizing . said work in accordance with Article 4413 (32c) of the ltttle3
Cooperation Act of VACS; and
tom,; WHEREAS,,: said :-roads ..'being Type "E" according to the Dallas County Road and Bridge
Policy..as...adopted in Court Order No. 84 -659 and Order Nos. 87 -2137 and
89 -416, establishing and updating the County Road List, are eligible for
County, cooperation.

CITY /COUNTY AGREEMENT
WHEREAS, the City of Coppell, Texas, hereinafter called "City"
and the County, of Dallas, Texas,.her_einafter called "County "' want to
enter... into an agreement for the resurfacing of Sanders Loop from
Bel Cline Road North /South to Beltl.ine Road East /West, Wrangler. St'r.eet
1.1.200' west .of' Beltline Road and Lock Street 600' north of Bethel. Roi d
which are 'type "r," roads (100% reimbursable to County); See Attachment
"A "'for the dimensions and estimated cost.
WHEREAS, Article 413 (32c), Vernon's Aiinotated Civil Statutes,
provides authorization for local governments to enter into contracts;
NOW, THEREFORE, THIS MEMORANDUM OF AGREEMENT is hereby made and
entered into by City and County upon and for the mutual consideration
stated.herein;
WITNESSETIT:
City:requests County to resurface Sanders Loop, Wrangler Street
snd Lock. Street (See Attachment "A ").. County to furnish labor, equipment
& materials for the. work. City to place in escrow with. County $57,367.94,
.. which i l:s the total estimated cost of the project.
II.
City will be responsible for'traffic control, lights, barricades,
signs and any necessary utility adjustments.
hII.
The County shall at all times exercise reasonable precautions for
the safety of employees and others on or near the work and shall comply
with a.11' applicable provisions of federal, stat.e and municipal safety
laws. The, "safety precautions actually taken and their adequacy shall he
the sole''responsibility of the County.
IV.
It is agreed that work will not start until this agreement has
been...fully'executed by the City and County.

The City further agrees to .indemnify and save harmless County
from any liability or damages County may suffer as'a result of claims,
.demands, costs or judgments against County arising out of the per -
Lormancc of the work and services under this agreement or ar.isi.nr from
any accident; injury or damage whatsoever, to any person or persons,
or:to the property of any person(s) or corporation(s) occurring during
the performance of this agreement and on or about this project,
except for any liability or damages caused by the negligence of the
County, its agents, officers and/or employees.
