Prior to ap- proval by the Commissioners Court, it was discovered that an error had been made in designating the limits of the project in the first paragraph of the Agreement. The Agreement originally stated that the project extends from "S.H. 114 to Denton Tap Road" when it should read "I.H. 635 to Denton Tap Road." The Agreement was cor- rected prior to submission to the Court. The copy attached reflects the intended limits, and we bring this to your attention so that you may make whatever changes are necessary in your records to indi- cate this amendment. Sincerely, Director of Public Works sg Attachments cc: Mayor Lou Duggan 161 Commerce Dallas, Texas 75207 749 -8151 THE STATE OF TEXAS ) COUNTY OF DALLAS ) CITY /COUNTY AGREEMENT WHEREAS, the City of Coppell, Texas, hereinafter called "City," and the County of Dallas, Texas, hereinafter known as "County," desire to enter into an agreement for the construction of paving and storm drainage improvements in connection with the Belt Line Road Project (I.H. 635 to Denton Tap Road) in the City of Coppell and County of Dallas; and WHEREAS, the Interlocal Cooperation Act, Article 4413(32c) Vernon Is Annotated Civil Statutes, provides authorization for any local government to contract with one or more local governments to per- form governmental functions and services under the terms of the Act; NOW, THEREFORE, THIS AGREEMENT is hereby made and entered into by City and County upon and for the mutual consideration stated herein: W I T N E S S E T H: I. City hereby requests County to participate in the cost of paving and storm drainage improvements as part of the Belt Line Road Proj- ect pursuant to Proposition No. 2 of the 1977 Dallas County Bond Program. II. County hereby agrees to reimburse City for cost of construction of the paving and storm drainage improvements in accordance with plans and specifications approved by the County. III. City hereby agrees to be responsible for administration of the proj- ect and construction contract for the improvements. City will pro- vide copies of all plans and specifications to County prior to the award of any contract for the construction. IV. County will provide funding in an amount not to exceed $700,000 for the construction of the improvements. City will submit invoices and supporting documentation to County for reimbursement, based upon a prorata percentage of the County's funding and the total construction contract amount, as costs are incurred by City until such time as the project is completed or the County funding limit is reached. City will be responsible for all costs required to complete the project which are in excess of the authorized County funding. M City will advise County during construction of all design changes. VI. City hereby agrees to credit County for any decrease in quantities of work upon completion and final acceptance of the work by City and return to County all funds provided to City but not used for construc- tion of paving and storm drainage improvements under this Agreement. < � 475- VII. City hereby agrees to defend, indemnify and save harmless County from any claims, demands, costs or judgments against County aris- ing out of any negligent act or omission of City or its contractor(s) in the performance of the work or services under this Agreement. Judy , Commissioner of District No. 2 , the following order was adopted: WHEREAS, the 1977 Bond Program authorized funding for partici- pation with the City of Coppell in the construction of paving and storm drainage improvements on Belt Line Road Project No. 494 -303 (S.H. 114 to Northlake) ; and WHEREAS, the City of Coppell has developed a project on Belt Line Road from I.H. 635 to Denton Tap which is eligible for County funding participation under Project No. 303; and WHEREAS, a City /County Agreement has been prepared on this project which basically provides that: a. The City will be responsible for administration of the project and construction contract for the improvements, and b. The County will be provided copies of plans and specifi- cations for review and approval prior to contract award, and C. The County's share of the costs of these improvements will not exceed $700,000, and d. The County will reimburse the City as costs are incurred upon submittal of documented invoices based upon a prorata percentage of the County's funding and the total construction contract amount; and T.TLT",MTT T C. t...- a : w — M I A IQ i a WHEREAS, the proposed agreement has been executed by the City of Coppell and forwarded to the County of Dallas for execution by the County Judge; and WHEREAS, the Director of Public Works has reviewed the Agree- ment and recommends its execution by the County. IT IS THEREFORE ORDERED,ADJUDGED AND DECREED by the Commis- sioners Court of Dallas County, Texas that the County Judge is here- by authorized to execute the City /County Agreement with the City of Coppell for the referenced improvements to Belt Line Road, and that reimbursement to the City of Coppell, as outlined above, is authorized from Bond Fund 494 -303 -831 -4 ($670,514.19) and from Fund 105 -1 ($29,485.81).
