Number 27John Wilmarth - GIS Data Restrictions Agreement.doc GIS Data Restrictions Agreement between the Dallas Central Appraisal District (DCAD) and the undersigned Parties Dallas Central Appraisal District The digital geographic features (parcel polygons, platted lines, subdivision boundaries, etc. hereinafter referred to as "geography, ") developed by the DCAD are provided, without warranty of any kind, to the taxing entities (municipalities, school districts and others) that the DCAD serves, as a courtesy for their internal purposes. A taxing entity may share all or part of the geography so provided with private contractors and consultants who are doing work for that taxing entity, subject to the contractor /consultant's written agreement to the following restrictions: A. The geography may only be used by the contractor /consultant for one project (scope of work.) with written permission and agreement. A second project will require a second written permission and agreement. B. The geography must be held by the contractor /consultant as privileged data. The contractor /consultant must take all prudent precautions to prevent the dissemination of the geography and may not release the geography to any party without the written permission of both the taxing entity and the DCAD. C. The geography must be deleted from all computer systems and computer readable data storage at the end of the project; however, results of the project (printed maps or data summaries, for instance) may be retained. The geography may be surrendered in computer readable format to the taxing entity who will maintain custody if a permanent record of the work performed is required. D. Modification of, or derivation from, the geography by the contractor /consultant for purposes of the project, or otherwise, shall not change the proprietary nature of the geography, nor relieve them of compliance with their agreement to these restrictions. I have been sent a GIS Data Restrictions Agreement to have signed by any parties interested in using our DCAD data to complete projects for Coppell. The original is to be mailed back to DCAD for their records. In this case, the consultant is Scott Sires. He wanted a copy of our most recent DCAD parcel layer for his work with the Coppell police. If you have any questions or concerns, please let me know. The contractor must agree in writing to be bound by the provisions of this Agreement. The contractor also agrees to return all NCTCOG data back to the Entity, or to destroy said data, after completion of the project. This data may not be used for other projects or presentations unless written permission is obtained from either the Entity or NCTCOG.
