STAFF COMMENTS:
Currently, the City of Lewisville has retained the services of S. J. Louis Construction, Inc.,
through the bidding process, to construct Denton Tap Road within their city limits. The
Interlocal Cooperation Act, Chapter 791 of The Texas Government Code, allows a City to
enter into an iWkJd l 099e � with another municipality to construct improvements for
other cities using a contractor already under contract. City staff met with the City of
Lewisville and the contractor to discuss the possibility of having S. J. Louis Construction, Inc.
construct the portion of Denton Tap Road within the City of Coppell from the north side of
S.H. 121 Bypass north to the city limit line. With the approval of this 1JA616W." agir l t
S. J. Louis Construction, Inc. could continue their work into the City of Coppell without any
time delay. Potentially, we could have the entire portion of Denton Tap Road north of the
bypass constructed by Spring of 1998. This would eliminate two transitions from 6 lanes to
2 lanes, therefore, providing a safer roadway.
Staff recommends approval of this hA&WW 00 with the City of Lewisville and will be
available for any questions at the Council meeting. .

WHEREAS, the City of Lewisville, Texas hereinafter called "Lewisville" and the
City of Coppell, Texas, hereinafter called "Coppell", wish to enter into an Agreement for
the construction of Denton Tap Road located within the city limits of the City of Coppell
north of Spur 553, also known as S.H. 121 Bypass; and
WHEREAS, Lewisville currently has under contract with S. J. Louis Constniction,
jam„ for the construction of Denton Tap Road in Lewisville; and
WHEREAS, this agreement will provide Coppell a cost benefit to extend the contract
with Lewisville to construct Denton Tap Road in the City of Coppell; and
WHEREAS, the Interlocal Cooperation Act, Chapter 791 of the Texas Government
Code, provides authorization for any local government to contract with one or more local
governments to perform governmental functions and services under the terms of said Act;
NOW THEREFORE, this Agreement is hereby made and entered into by the Cities
of Lewisville and Coppell for the mutual consideration stated herein:
I.
Coppell hereby requests Lewisville to construct pursuant to the terms of this
Agreement Coppell's section of Denton Tap Road located north of Spur 553, also known as
S.H. 121 Bypass as indicated in the construction plans and specifications dated
approved by the City of Coppell and incorporated herein by reference.
II.
Coppell hereby agrees to provide funding in the estimated amount of S 424,604.05
out of currently available funds in accordance with Attachment "A ", for the cost of design,
construction, relocation, adjustment and betterment of certain improvements described
herein.

Coppell hereby, agrees to provide all inspection services for construction . of the
portion of Denton Tap Road located in the City of Coppell.
IV.
Coppell hereby agrees to be responsible for approval of all design changes and to
provide for any additional funding necessitated thereby, or for any increase in the quantity
of Coppell's construction.
V.
Lewisville agrees that it will not make any payment, progress or final, to the
construction contractor performing Coppell's road construction under this Agreement until
construction has been approved in writing by Coppell. Lewisville agrees that all payments
to the construction contractor shall be based on measured quantities of construction
completed as furnished to Lewisville by the City of Coppell City Engineer or his designated
appointee.
VI.
Lewisville agrees to prepare and execute a change order to extend construction of
Denton Tap in to Coppell in accordance with approved plans and specifications.

Lewisville hereby agrees that construction will not commence until this Agreement
has been bully executed by Lewisville and Coppell.
VIII.
Lewisville hereby agrees to immediately advise Coppell of any and all design changes
which may occur during construction.
IX.
Lewisville hereby agrees to credit Coppell for any decrease in quantities of
construction upon completion and final acceptance of the work by Coppell and to return to
Coppell all funds provided but not used for the work under this Agreement.

S. Proposal b" upon commencement of construction for proposed work by December 22, 1997.
C. Start-up iterh includes Performance, Payment & Mainterience bonds to City of Lewisville,
a seperate two year so% maintenence Bond for this proposal amount to the City of Coppell,
testing laboOtory fees for required concrete, lime subgrade and compaction tests and all staking
and engineqring required for the work.

E Proposal balsed upon existing traffic flow / controls remaining In place as they currently
exist to allo4 all of the proposed work to be constructed in one move-in.

contract to bomplete the work.

in the existing City of Coppoll Park located south of Denton Crook and Denton Tap Road for futur(
