REPEALING CLAVSE: PROVIDING A SEVERABILITY CLAllSE; AND PROVIDlNG
FOR AN EFFECTIVE DATE.
WHEREAS, a Spedal Use Permit is required for oil and gas drilling and petroleUM
extraction; lind,
WUEREAS, while the permittirtg of this use is ultimately the responsihilhy of the Tcxas
Railroad Commission, with pll1ticipation by the Texas Commission on Environmental Quality
(TCEQ), EnvimnmentProjeetion Agency (EPA) and other various agenciel>, mU11icipalities may
impose reasonable restrictions. but ma)' nol prohibit this LIse; and.
WHEREAS, the Cil)' COlJm::i1 has adopted by ordinance provii>ions regulating (lil and gas
drilling within lhe city; llmt
WHEREAS. it is OOl.>:eSSat'y h) protect the general healtlt. safety, and welfare of the:
cititens in the event that a viable wel[ site is discovered; and,
WHEREAS, it is no longer ne.::essary to regulate Ihi5 use under the Special Use Permit
provisiuns of the Comprehensi \'e loni ng Ordi nanee; and,
WHEREAS, the Planning and Zoning Commission has reviewed lhe proposed
amendment and has sent a recommendation 10 the eft)' COlloe111o approve lhe~aid amendment
10 the specified sections. and
WHEREAS, lhe City Council is of the (lpinion that Sectioo$ 12-8.0. 12-25-1, 12.3Q-41
and 12.30.125 of the 7.00ning Ordinance should be amended;
NOW. THEREFORE, BE IT ORDAINED BY THE cln' COUNCIL OF THE
CITY OF (:OPPt:tL, TEXAS;
SECflON t. That the Code of Ordinance of the City of Co()poell, Texas, be, and the
same is, hereby amended by amending Chapter 12, Sections 12-S-O and 12-25-1 by adding a

provision lor oil and gas drilling; and by amending Sections i2-JQ-41 and 12-30--125 by
deletins the requirement for a SUP and to provide reference to Cll3pler 9, Sectkl11 21\ which shall
read as follows
